THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his deployment to Iraq from 20070509 - 20080726 (2007 May 9 to 2008 July 26) be included in Item 18 (Remarks) of his 
DD Form 214 (Certificate of Release or Discharge from Active Duty) with a separation date of 23 October 2008.

2.  The applicant states that his third period of deployment is not included on his DD Form 214.

3.  The applicant provides, in support of his application, copies of his Enlisted Record Brief (ERB) and his DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  The applicant's military personnel records show he enlisted in the Regular Army on 17 June 2003.  He completed basic combat training and advanced individual training and was awarded the military occupational specialty of 31B (Military Police).

2.  Section I (Assignment Information) of the applicant's ERB shows the following overseas/deployment combat duty tours:

	a.  20070509 - 20080726 country code IZ (Iraq);

	b.  20051207 - 20061206 (2005 December 7 to 2006 December 6) country code IZ; and
	c.  20031216 - 20040330 (2003 December 16 to 2004 March 30) country code IZ.

3.  On 23 October 2008, the applicant was released from active duty by reason of completion of required active service.  He completed 5 years, 4 months, and 
7 days of active service that is characterized as honorable.

4.  Item 18 of his DD Form 214 only includes the following periods of deployment:

	a.  Service in Kuwait/Iraq-Operation Iraqi Freedom: 20031216 - 20040330; and

	b.  Service in Kuwait/Iraq-Operation Iraqi Freedom: 20051207 - 20061206.

5.  Army Regulation 635-5 (Separations Documents) provides, in pertinent part, that the Soldier's ERB is among those source documents to be used when preparing the DD Form 214.

6.  Army Regulation 635-5 also provides that when an active duty Soldier is deployed with his unit during the period covered by the DD Form 214, an entry will be made in item 18 to show the name of the country deployed to and the inclusive dates in YYYY/MM/DD format.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's ERB clearly shows a third period of deployment from 20070509 - 20080726 with a country code of IZ and this period is not included on his DD Form 214.

2.  The applicant’s first two periods of deployment are shown on both his ERB and his DD Form 214.  The country code for the periods of deployment from 20031216 - 20040330 and 20051207 - 20061206 are shown on the applicant’s ERB as IZ.  The entry shown in item 18 of the applicant's DD Form 214 for both periods of deployment is Kuwait/Iraq-Operation Iraqi Freedom with the dates of deployment. 

3.  Therefore, it would be appropriate to show the applicant's third period of deployment on his DD Form 214 as "Service in Kuwait/Iraq-Operation Iraqi Freedom: 20070509 - 20080726."

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to item 18 of the applicant's DD Form 214 the entry "Service in Kuwait/Iraq-Operation Iraqi Freedom: 20070509 - 20080726."
