IN THE CASE OF:
BOARD DATE: 9 December 2008
DOCKET NUMBER: AR20080014903
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that item 17a (Current Active Service other than by Induction, Source of Entry) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period ending 23 September 1970 be corrected to show he was not ordered to active duty for training (ACDUTRA).
2. The applicant states that item 17a shows he was on ACDUTRA. Because of that entry, he is being denied health care by the Department of Veterans Affairs. He was ordered to active duty because he missed some Reserve meetings. While on active duty, he performed the same duties and had the same status as someone who was drafted or enlisted.
3. The applicant provides a copy of his DD Form 214 for the period ending 23 September 1970 in support of his application.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the U. S. Army Reserve (USAR) on 25 June 1965. He was ordered to initial active duty for training on 23 March 1967 and was released from active duty on 24 July 1967.
3. The applicant had a number of unexcused absences from scheduled unit training assemblies. Headquarters, Sixth United States Army, Presidio of California Reserve Letter Orders Number A-01-0009, dated 8 January 1969, ordered him to active duty, effective 22 March 1969, for 18 months and 13 days.
4. The applicant entered involuntary active duty on 22 March 1969 and was released from active duty on 23 September 1970 after completing 1 year, 6 months, and 2 days of creditable active service.
5. Item 17a of the applicant's DD Form 214 for the period ending 23 September 1970 indicates he was ordered to ACDUTRA from the USAR.
DISCUSSION AND CONCLUSIONS:
1. The applicant was not ordered to active duty for training on 22 March 1969. He was ordered to involuntary active duty as a result of having a number of unexcused absences from his scheduled USAR unit training assemblies.
2. Item 17a of the applicant's DD Form 214 for the period ending 23 September 1970 contains an administrative error and should be corrected to reflect he was ordered to involuntary active duty instead of reflecting that he was ordered to active duty for training.
BOARD VOTE:
___X_____ ____X____ ___X_____ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
________ ________ ________ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
a. deleting the entry, "ORDERED TO ACDUTRA FROM USAR" from item 17a of his DD Form 214 for the period ending 23 September 1970; and
b. adding the entry, "ORDERED TO INVOLUNTARY ACTIVE DUTY FROM USAR" to item 17a of his DD Form 214 for the period ending 23 September 1970.

The applicant requests, in effect, that item 17a (Current Active Service Other than by Induction) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) that was issued on 24 September 1969 be corrected to show that he was ordered to active duty (AD) instead of ordered to active duty for training (ACDUTRA). The applicant essentially states that his DD Form 214 that was issued on 24 September 1969, which will simply be referred to as his second DD Form 214...

The applicant requests, in effect, that the entry in item 17a (Current Active Service Other Than by Induction/Source of Entry) on his DD Form 214 (Report of Transfer or Discharge) for the period ending 14 July 1969 be corrected. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. His activation orders, issued by the XX United States Army Corps, specifically state that he was being ordered to active duty for the purpose of training (ACDUTRA). Again the orders specifically state the applicant was being ordered to active duty for the purpose of training. It is clear, based on the various documents which ordered the applicant to active duty, that his final period of active service, 28 September 1968 through 27 April 1969, was not for the purpose of training but rather...

Application for correction of military records (with supporting documents provided, if any). The applicant states his DD Form 214 shows he was ordered to active duty for training (ACDUTRA) on 4 September 1968. The applicant contends that item 17 of his DD Form 214 should be corrected because he was ordered to active duty and not "Ordered to ACDUTRA."
ARMY | BCMR | CY2004 | 20040011695C070208
This DD Form 214 shows the applicant was ordered to Active Duty for Training (ACDUTRA) for the period 3 April 1965 through 1 October 1965. Evidence of record shows the applicant already held the MOS 76D20 when he was involuntarily ordered to active duty. Therefore, the applicant is entitled to correction of his DD Form 214, in item 17a, to show he was on active duty for the period 26 August 1968 through 6 February 1970.
ARMY | BCMR | CY2003 | 2003083877C070212
The applicant requests that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), dated 2 March 1970, be corrected by deleting the phrase "ORDERED TO ACDUTRA 1 YR 6 MOS" in Block 17a, and by showing that he was order to active duty. The applicant states that he was not ordered to active duty for training (ACDUTRA) as his DD Form 214 indicates; he was ordered to active duty. The applicant’s military records were not available.
ARMY | BCMR | CY2005 | 20050004545C070206
His DD Form 47 (Record of Induction) shows he was inducted into the Army on 17 March 1970. The evidence of record shows the applicant was inducted into the Army on 17 March 1970. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief and to excuse failure to timely file.
ARMY | BCMR | CY2013 | 20130007230
The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period ending 9 January 1970 to show in: a. item 5a (Grade, Rate, or Rank), his rank and pay grade as sergeant (SGT)/E-5 instead of private (PV2)/E-2; b. item 16 (Terminal Date of Reserve), his terminal date as 22 September 1975 instead of 21 May 1975; c. item 17c (Date of Entry), he entered active duty on 22 September 1969 instead 10 September 1969; and d. item...
ARMY | BCMR | CY2006 | 20060011761
The applicant's military service records contain a DD Form 214, with an effective date of 20 October 1969. The applicant contends, in effect, that his DD Form 214, with an effective date of 20 October 1969, should be corrected to show he was ordered to active duty rather than ordered to active duty for training. However, the evidence of record shows that this service is not accurately recorded on the applicant's DD Form 214, with an effective date of 20 October 1969.

Records available to the Board indicate that the applicant enlisted in the United States Army Reserve for a period of 6 years on 7 May 1964. Although the applicant was in fact a member of the United States Army Reserve at the time he was ordered to active duty in 1968, he was not ordered to active duty for training purposes as his 1969 separation document indicates. While the evidence does not indicate that the applicant was integrated into the Regular Army when he was order to active...
