THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that the Social Security Account Number (SSAN) reflected on his separation document (DD Form 214) be corrected from reading xxx-xx-x289 to xxx-xx-x891.

2.  The applicant states the SSAN listed on his DD Form 214 is incorrect and he needs it fixed to process his claim with the Department of Veterans Affairs (VA).

3.  The applicant provides his DD Form 214, and a letter from the Social Security Administration, dated 23 November 2007 which indicates SSAN xxx-xx-x2891 is assigned to an individual of the same name as the applicant.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant’s military records show he was inducted and entered active duty on 23 June 1965.  All of his military records which reflect an SSAN show the SSAN of xxx-xx-x891.

3.  The applicant was honorably released from active duty in pay grade E-5 on 22 June 1967.  The DD Form 214 he was issued shows his SSAN as
xxx-xx-x2289.

DISCUSSION AND CONCLUSIONS:

1.  It is evident that the applicant’s SSAN was xxx-xx-x891 since all the records in his military records which show an SSAN reflect that number.

2.  As such, the SSAN xxx-xx-x289 was obviously a typographical error and should now be corrected.
