THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that the DA Form 1059 (Service School Academic Evaluation Report), for the Warrior Leader Course, Class 007-08, be removed from her records.

2.  The applicant states that she failed the Warrior Leader Course in March 2008. She continues to state that she returned to the Warrior Leader Course in June 2008 and passed the course.  She wants her passing DA Form 1059 to replace the failing DA Form 1059.

3.  The applicant provides a copy of her DA Form 1059 for the Warrior Leader Course, Class 009-08, in support of this application.

CONSIDERATION OF EVIDENCE:

1.  The applicant's military service records show that she enlisted in the Regular Army on 25 February 2004.  She completed basic training and advanced individual training and was awarded the military occupational specialty 88M (Motor Transport Operator).

2.  DA Form 1059 dated 10 April 2008 shows that the applicant was released from the Warrior Leader Course, Class 007-08, on 10 April 2008 for academic reasons.  Item 11d (Failed to Achieve Course Standards) of the DA Form 1059 is supported by the comment in item 14 (Comments) which specifies that she was a second-time failure on the land navigation performance evaluation.

3.  DA Form 1059 dated 25 June 2008 for the Warrior Leader Course, 
Class 009-08, for the period 27 May 2008 through 25 June 2008 shows that the applicant achieved course standards and successfully completed the course.

4.  Army Regulation 600-8-104 (Military Personnel Information Management/ Records) prescribes policies, operating tasks, and steps governing the Official Military Personnel File.  This regulation provides, in pertinent part, that Service School Academic Evaluation Reports will be filed in the performance section of a Soldier’s Official Military Personnel File.

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s request that the DA Form 1059 for failure of the Warrior Leader Course be removed from her records was carefully considered and determined to be without merit.

2.  DA Form 1059 dated 10 April 2008 shows that the applicant was released from the Warrior Leader Course, Class 007-08, on 10 April 2008 for academic reasons.

3.  DA Form 1059 dated 25 June 2008 for the Warrior Leader Course, 
Class 009-08, shows that the applicant successfully completed this course.

4.  Army Regulation 600-8-104 provides that Service School Academic Evaluation Reports will be filed in the performance section of a Soldier’s Official Military Personnel File.

5.  The applicant did not provide evidence of error or injustice in support of her request.

6.  In view of the foregoing considerations, there is no evidence of error or injustice.  In order to justify correction of a military record the applicant must, or it must otherwise satisfactorily appear, that the record is in error or unjust.  The applicant did not submit evidence that would satisfy this requirement.  Therefore, she is not entitled to relief in this case.
