IN THE CASE OF:
BOARD DATE: 15 October 2008
DOCKET NUMBER: AR20080011658
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that his records be corrected to show his pay entry basic date (PEBD) as 1 April 1967.
2. The applicant states he enlisted on 1 April 1967 and retired on 31 May 2008. By his calculations, the total service time is 41 years and 2 months. The Defense Finance and Accounting Service (DFAS) uses 32 years and 2 months of service to compute his pay rate effective 1 January 2008.
3. The applicant provides his certificate of retirement and his National Guard Bureau Form 22 (Report of Separation and Record of Service) in support of his application.
CONSIDERATION OF EVIDENCE:
1. The applicant was born on 31 May 1948. He enlisted in the Army National Guard on 1 April 1967. His Army National Guard Current Annual Statement, dated 28 September 1988, shows that through retirement year ending 31 March 1988 he never had a break in service and satisfactorily participated during each retirement year throughout his service with the Army National Guard.
2. On 30 October 1989, the applicant was discharged from the Army National Guard and transferred to the Retired Reserve effective 31 October 1989.
3. On 31 May 2008, the applicant turned aged 60 and began to draw retired pay.
4. Records at the U. S. Army Human Resources Command St. Louis show the applicants PEBD as 1 April 1967. Records at DFAS show his PEBD as 31 March 1976.
DISCUSSION AND CONCLUSIONS:
1. The evidence of record shows that the applicant enlisted in the Army National Guard on 1 April 1967 and had continuous, satisfactory service until he was transferred to the Retired Reserve effective 31 October 1989.
2. The applicants PEBD is, and is recorded at the U. S. Army Human Resources Command St Louis as being, 1 April 1967. It appears an error may have been made when that Command informed DFAS that he was eligible for retired pay (i.e., using his retirement year ending of 31 March instead of his retirement year beginning of 1 April and transposing 1967 into 1976).
3. All of the applicants records should be corrected to show his PEBD as 1 April 1967.
BOARD VOTE:
___XX_____ ____XX____ ____XX____ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
________ ________ ________ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
a. showing that, when the U. S. Army Human Resources Command St. Louis informed DFAS that he was eligible for retired pay, that Command informed DFAS his pay entry basic date was 1 April 1967; and
b. if appropriate, adjusting his retired pay to reflect his PEBD as 1 April 1967 and paying him any back due retired pay (or informing him why his pay as currently calculated is correct).

This time accounts for his first period of Regular Army active service and his 42 days of active service while in the Reserve components. A letter, dated 27 July 2010, from DFAS to a Member of Congress states, in pertinent part, the applicant's military records reflect he has 29 years, 3 months, and 11 days for his service base pay; the Department of the Army retired the applicant with 24 years, 4 months, and 26 days of total active service (service percent multiplier); and the service...

The applicant enlisted in the ARNG on 19 September 1985 for 8 years. The evidence of record shows the applicant never had a break in service (contrary to the applicants belief) from the time he enlisted in the ARNG on 19 September 1985 until he was transferred to the Retired Reserve in April 2007. The applicants records should be corrected to show he enlisted in the USAR effective 18 September 1999 for 3 years, that he never had a break in service, and that his PEBD is 19 September 1985.

Therefore, he requests that his records be corrected to show his service in the SMP while serving in the United States Army Reserve Officer Training Corps (ROTC) and the United States Army National Guard. Evidence of record shows that the applicant enlisted in the USAR on 3 September 1980 but was not assigned as an ROTC cadet in MOS 09R20 until 1 December 1980. There is no evidence that the applicant performed any active duty service during the time he was granted SMP credit.

The applicant requests that his promotion orders (Orders B-01-800898, dated 31 January 2008) be amended to show his date of rank (DOR) to lieutenant colonel (LTC) as 21 December 2007 or the earliest possible date following the release of board results. The commanding officer stated the applicant was assigned to an LTC position as of 15 August 2007 and his promotion effective date should be 21 December 2007 (the approval date of the board). As a result, the Board recommends that all...

b. three of his LES's that show for the period: * 1-31 July 1985, a PEBD of 14 June 1974 * 1-31 December 1988, a PEBD of 11 January 1979 * 1 August 2003, a pay date of 5 October 1977 c. an ILARNG memorandum, dated 9 June 2005, that shows the Retirement Points Accounting Management noncommissioned officer requested that the Pay Branch change the applicant's PEBD to 22 March 1974. DFAS records shows the applicant's current retirement date is 1 October 2007 and that he has 30 years, 1 month,...

The applicant states that she was not notified that the FSM did not elect the SBP and that the Army National Guard (ARNG) should have sent a letter to let her know that he did not make an election. This system shows the following entries for the FSM: a. on 7 January 2008, the FSM contacted HRC-St. Louis requesting assistance in completing his paperwork for retired pay and his SBP application. However, his records do not indicate that he elected to participate in the RCSBP and the applicant...

The applicant requests that his pay entry basic date (PEBD) be changed to 25 June 1999. That individual stated that the applicant’s PEBD is showing as 21 August 1991, “which is correct.” That individual stated that the PEBD is computed by taking the original date [of enlistment] and adding all lost time and breaks. It appears USAHRC – STL calculated the applicant’s adjusted PEBD based upon a USAR discharge date of 9 November 1995, the date his statutory military service obligation would...

The applicant requests, in effect, correction of his records to show creditable service for his active duty service in 1970 and 1991. The applicant contends, in effect, that his military service records should be corrected to show creditable service for his active duty service in 1970 and 1991 and requests an explanation regarding the calculation of his retired pay. Thus, the evidence of record shows that the applicants military personnel records properly document this active duty...

The applicant is confusing the service (i.e., 26 years, 4 months, and 12 days as shown on his corrected Chronological Statement of Retirement Points) he would have been credited with had he retired with an enlisted Reserve retirement at age 60 with the service he was eligible to be credited with as a commissioned officer who retired from active duty. For example, had the applicant retired with an enlisted Reserve retirement or even with an enlisted active duty retirement, all of his service...
