		IN THE CASE OF:

		BOARD DATE: 5 March 2009

		DOCKET NUMBER: AR20080010108

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that her 22 March 2008 DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show that she entered active duty on 25 September 2006.

2. The applicant states, in effect, that her mobilization orders show her reporting date as 25 September 2006.

3. The applicant provides a copy of Headquarters, Military Intelligence Readiness Command, Fort Belvoir, Virginia, Orders 06-264-00011, dated
21 September 2006 in support of her application.

CONSIDERATION OF EVIDENCE:

1. The applicant, a U. S. Army Reserve (USAR) officer, was mobilized with her troop program unit.

2. Her mobilization orders directed that she report to Fort Benning, Georgia on
25 September 2006 for 455 days of active duty service for the purpose of mobilization in support of Operation Enduring Freedom.

3. She was released from active duty on 22 March 2008.

4. Her DD Form 214 shows in block 12a (Date Entered AD [Active Duty] This Period) that she entered active on 9 March 2008. Block 12b (Separation Date This Period) shows she was released from active duty on 22 March 2008 and transferred back to her USAR unit. Block 12c indicates she served on active duty for 1 year, 6 months, and 1 day during this period of service.

5. Her Officer Evaluation Report (OER) for the period ending 24 September 2006 praises her contributions as a member of her USAR unit. The OER for the period beginning 25 September 2006 shows she was on active duty with her unit, Headquarters and Headquarters Company, CJTF [Combined Joint Task Force]-82, Bagram Airfield, in Afghanistan.

6. Army Regulation 635-5 (Personnel Separations - Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. It states that:

   a. for block 12a, enter the beginning date of the continuous period of active duty for issuance of this DD Form 214, for which a DD Form 214 was not previously issued; and

   b. for block 12c, enter the amount of service this period, computed by subtracting block 12a from block 12b.

DISCUSSION AND CONCLUSIONS:

1. The applicant's contention that her DD Form 214 should show she entered active duty on 25 September 2006 was found to have merit.

2. Her mobilization orders show she was mobilized on 25 September 2006 in support of Operation Enduring Freedom, and her OER for the period ending
24 September 2007 shows her unit as Headquarters and Headquarters Company, CJTF-82, Bagram Airfield, Afghanistan with a beginning date of this report as 25 September 2006. Therefore, block 12a of her DD Form 214 should be corrected to show the entry, "2006 09 25."

BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting from block 12a of the applicant's DD Form 214 the entry "2008 03 09" and replacing it with the entry "2006 09 25."

It stated Reserve Component (RC) Soldiers mobilized to active duty under Title 10 are performing "active Federal military service" and are therefore eligible to be awarded the AGCM. Award of the ARCAM requires the individual to complete 3 years of exemplary service in either the USAR or ARNG; however, the time served on active duty is not credited toward that 3-year period and the eligibility period starts the day after completion of active duty. As a result, the Board recommends denial of...
