IN THE CASE OF:
BOARD DATE: 21 August 2008
DOCKET NUMBER: AR20080008582
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that item 17 (Member Was Provided Complete Dental Examination and All Appropriate Dental Services and Treatment within 90 Days Prior to Separation) be changed from Yes to No.
2. The applicant states that block 17 on his DD Form 214 indicates he was provided all appropriate dental services within 90 days of separation. He had 137 days terminal leave and permissive temporary duty (PTDY) and dental problems arose prior to his actual retirement date and the military could not complete all the required dental work. He states that the Department of Veterans Affairs (VA) was going to complete the remaining portion of the dental care needed but they could not because block 17 on his DD Form 214 was checked Yes. He really needs this care [dental] completed and his DD Form 214 corrected to indicate he did not receive all appropriate dental services prior to his separation from the military.
3. The applicant provides four Standard Forms 603A (Chronological Record of Dental Care) and his DD Form 214.
CONSIDERATION OF EVIDENCE:
1. After having had prior enlisted service, the applicant was appointed as a Reserve warrant officer on 15 March 1994 with a concurrent call to active duty. He was promoted to Chief Warrant Officer Four (CW4) on 1 January 2006.
2. On 15 January 2008, the applicant received dental treatment on three of his teeth. The dentist indicated the applicant needed follow-up treatment on one of his teeth.
3. The applicant received follow-up dental treatment on 17 January 2008 on one of his teeth. The dentist indicated that the applicant needed follow-up treatment on one of his teeth.
4. The applicant received dental treatment on 6 February 2008 for treatment on one of his teeth. His chief complaint, I need a root canal on the second from the last tooth on the top right. The treatment on this tooth was completed.
5. The applicant returned to the dental clinic on 11 February 2008 for treatment. He stated that the tooth that recently received the root canal was sore and hard to chew on.
6. The applicant was released from active duty and retired on 31 March 2008.
7. Item 17 on the applicants DD Form 214 shows the entry Yes.
8. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. It states that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge.
DISCUSSION AND CONCLUSIONS:
1. The evidence of record shows the applicant received dental treatment on 11 February 2008, six weeks prior to his retirement date.
2. It appears he needed additional dental care after his treatment on 11 February 2008. However, his DD Form 214 shows he was not provided all appropriate dental services and treatment prior to his retirement on 31 March 2008.
3. It would be appropriate to amend item 17 on the applicants DD Form 214 to reflect No.
BOARD VOTE:
___xx___ __xx____ __xx____ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
________ ________ ________ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending item 17 on his DD Form 214 to show No.

If the Soldier had been provided a complete dental examination, and all appropriate dental services and treatment had been completed within 90 days prior to separation, the DD Form 214, item 17, Member was provided complete dental examination and all appropriate dental services and treatment within 90 days prior to separation will be marked Yes. DISCUSSION AND CONCLUSIONS: 1. Since the applicant's medical records were not provided to the Board, the original copy of this form and the...

The applicant requests that her DD Form 214 dated 29 March 2008 be corrected to reflect a "NO" entry in block 17 under "Member was provided complete dental examination and all appropriate dental services and treatment within 90 days prior to separation". The statement from the attending dentist clearly indicates the applicant had been identified for further dental treatment prior to separation at Fort Irwin, California. As a result, the Board recommends that all Department of the Army...

Kenneth Wright | |Member | The Board considered the following evidence: Exhibit A - Application for correction of military records. The fact that the applicant had a dental appointment scheduled after his discharge does not mean that all appropriate dental services and treatment had not been completed prior to his separation. Item 17 on his DD Form 214, however, shows that all appropriate dental services and treatment had been completed.
CG | BCMR | Discharge and Reenlistment Codes | 2010-131
A waiver must be obtained in order to reenlist.” However, his DD 214 shows an honorable discharge pursuant to Article 12-B-12 of the Person- nel Manual with an RE-4 reenlistment code and a JFC separation code. The applicant was discharged and received his DD 214 with the RE-4 reenlistment code in 1994. Therefore, the Board finds that the applicant has proved by a preponder- ance of the evidence that his RE-4 code is erroneous and should be upgraded to an RE-3E.

Only those defects which are, might or will cause a soldier problems on active duty are required to be treated. There is no record of the applicant having any outstanding dental defects at the time of his separation from active duty. While the applicant opted to have partial dentures, pontic and crowns made and installed shortly after his retirement, there is no evidence that his dental condition required such treatment for him to remain on active duty.

Counsel also asks that the Board consider the applicant's depression which he states is fully documented in his active duty medical records with reference back to August 2002. The VA, counsel states, has rated the applicant's depression at 30%. Consideration was given to the applicant's contention that his separation document should be corrected to show he was permanently retired with a disability rating of 30 percent and entitled to back pay and allowances to the date of his separation;...

The first letter, dated April 1951, is from the chief of the dental service for the Veterans Administration. The Chief Counsel stated that the applicant’s “request is...
