THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his Certificate of Release or Discharge from Active Duty (DD Form 214) to show award of the Joint Meritorious Unit Award (JMUA).

2.  The applicant states, in effect, that he was a part of the 109th Quartermaster (QM) Company when it was awarded the JMUA.  He also states that he was never assigned to the 54th QM Company or to the 58th QM Company.

3.  The applicant provides no additional documentation.

CONSIDERATION OF EVIDENCE:

1.  On 6 September 2002, the applicant enlisted in the Regular Army for 6 years. He completed his initial training and was awarded military occupational specialty 92F (Petroleum Supply Specialist).  He was subsequently assigned for duty at Fort Lee, Virginia.

2.  The applicant’s Enlisted Record Brief (ERB) dated 12 July 2006 shows that he was assigned to the following units during the periods indicated:

	a.  49th QM Battalion on 24 July 2003;

	b.  58th QM Battalion from 24 July to 6 November 2003;

	c.  109th QM Company from 7 to 29 November 2003;

	d.  58th QM Battalion from 30 November to 8 December 2003;

	e.  109th QM Company from 9 December 2003 to 31 May 2006;

	f.  530th Supply Service Battalion from 1 to 22 June 2006; and

	g.  240th QM Battalion from 23 June to 11 September 2006.

3.  Section VIII (Awards and Decorations) of the applicant’s ERB dated 12 July 2006 lists his awards as the Army Good Conduct Medal, National Defense Service Medal, Army Service Ribbon, and the Global War on Terrorism Service Medal.  It does not show award of a JMUA.

4.  On 11 September 2006, the applicant was discharged from military service.  He had completed 4 years and 6 days of creditable active duty.  

5.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of the applicant’s DD Form 214 lists the same awards as shown on his ERB.  It does not list the JMUA.

6.  DOD Instruction 1348.33 (Military Awards Program) provides, in pertinent part, that the Joint Meritorious Unit Award was authorized by the Secretary of Defense on 10 June 1981.  It is awarded to recognize joint units and activities for meritorious achievement or service, superior to that which is normally expected.  Qualifying achievements must be superior to that which is expected under conditions of combat with an armed enemy of the United States, a declared national emergency situation or extraordinary circumstances and should be operational in nature.  The Joint Meritorious Unit Award may not be awarded to any DOD activity which has received any other unit award for the same achievement or period of service.  

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s contention that he was assigned to the 109th QM Company at a time when it was awarded the JMUA is not supported by any available evidence.  Therefore, his request for this award should be denied.

2.  However, should the applicant have a copy of the award orders, or other substantiating evidence; or obtain such evidence, he may submit another application for consideration.
