THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that she be paid Board Certification Pay (BCP) from 1 January 2003 through 15 May 2006.

2.  The applicant states no one in Germany could help her get it started again.  Her finance office kept telling her to go to special pay; special pay told her to go to finance.  She was finally able to get it restarted by going on temporary duty to the U. S. Army Human Resources Command; however, they were able to get only one year of back pay.

3.  The applicant provides a self-authored statement, dated 6 July 2007; two American Board of Family Practice certifications as a diplomate of that board; a printout from her Special Pay Record Brief in the Medical Operational Data System; her leave and earnings statement for the period June 2007; and an email dated 3 July 2007.

CONSIDERATION OF EVIDENCE:

1.  After having had prior, non-Army Medical Department (AMEDD) commissioned service, the applicant was appointed a captain in the Medical Corps on 16 May 1992 and entered active duty.  She was board certified by the American Board of Family Practice for the period 1995 through 2002 and 2001 (sic) through 2008.

2.  In the processing of this case, an advisory opinion was obtained from the AMEDD Special Pay Branch.  The advisory opinion noted that the applicant did not receive BCP for the period 1 January 2003 through 15 May 2006 even though official documentation submitted indicates certification during this period.  That office started her BCP as of 16 May 2006.  The advisory opinion recommended the applicant receive BCP in arrears for the period 1 January 2003 through 15 May 2006 utilizing a Health Professions Pay Entry Date or Finance MS-Pay-Date of 16 May 1992 for the correct pay-rate level.

3.  A copy of the advisory opinion was provided to the applicant for comment.  She did not respond within the given time frame.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contended that she attempted to get her BCP restarted, but officials at her station in Germany were unable to help her.  She finally got it restarted after returning to the States and talking to officials at the U. S. Army Human Resources Command.
2.  The AMEDD Special Pay Branch confirmed that the applicant did not receive BCP for the period 1 January 2003 through 15 May 2006 even though official documentation submitted indicates certification during this period.  That Branch restarted her BCP as of 16 May 2006.

3.  It would be equitable to pay to the applicant BCP retroactive to the date she was first eligible to receive it.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by paying to her board certification pay for the period to 1 January 2003 through       15 May 2006 utilizing a Health Professions Pay Entry Date of 16 May 1992 to determine the correct pay level.
