BOARD DATE: 23 August 2007

The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion, if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that her reentry (RE) code on her DD Form 214 (Certificate of Release or Discharge from Active Duty) with the ending period
23 December 2003 be corrected.
2. The applicant states, in effect, that there is no legal or understandable RE code on her DD Form 214.
3. The applicant provides a copy of her DD Form 214; a 641st Mobilization Troop Command memorandum, dated 17 December 2004; a Legal Review letter, dated 15 December 2004; and a U. S. Army Human Resources Command memorandum, dated 21 December 2004.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the United States Army Reserve (USAR) on
15 October 1998 for an 8-year term of service. It appears that she entered active duty in an Army Guard Reserve (AGR) status as of 10 November 1998.
2. On 23 December 2004, the applicant was discharged from active duty and the USAR.
3. Her DD Form 214 with the ending period 23 December 2004 shows in item 8.a (Command to which Transferred) "NA," in item 27 (Reentry Code) shows the entry "NA," and in item 28 (Narrative Reason for Separation) shows the entry "PARENTHOOD."
4. Army Regulation 635-5 (Separation Documents) provides preparation instructions for the DD Form 214. The instruction for completing item 27 state these codes are not applicable to officers, U.S. Military Academy (USMA) cadets who fail to graduate or enter USMA from active duty status, or to Reserve Component Soldiers being separated for other than cause.
DISCUSSION AND CONCLUSIONS:
1. The applicants requested that her RE code be corrected. However, evidence of record shows that her DD Form 214 with the ending period 23 December 2004 shows that she was discharged due to parenthood. By regulation, this mandated that she not be assigned an RE code because she was being separated for other than cause. Therefore, the RE code of "NA" on her DD Form 214 is correct.
2. The applicant should be aware that the entry of "NA" is not an enlistment disqualifier.
BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

Evidence of record shows the applicant was involuntarily separated on 30 April 1992 under the QMP. The evidence of record confirms that the applicants separation...

The applicant requests correction of military records as stated in the application to the Board and as restated herein. The separation action was approved and on 15 August 1995 the applicant was discharged with an honorable characterization of service. The Board notes that there is no evidence of error or injustice in the applicant's separation and that fact that she is now married does not invalidate the original basis for her 1995 separation action.

IN THE CASE OF: BOARD DATE: 30 March 2010 DOCKET NUMBER: AR20100010737 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Her records also show she transferred to the U.S. Army Reserve (USAR) on an unknown date. It states that item 27 shows the RE code.

She is currently trying to go in under another branch of Service and is not able to do so due to those codes. On or about 14 March 2006, the applicants commander initiated involuntary separation action on the applicant under the provisions of Army Regulation 635-200, paragraph 5-8 due to parenthood due to the applicants failure to maintain a valid Family Care Plan. Item 26 of her DD Form 214 shows she was given a separation code of JDG (involuntary discharge under the provisions of...

The applicant states her separation document lacks the appropriate separation and RE codes for an honorably discharged Soldier. The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty to include attendance at basic and advanced training and is prepared for all personnel at the time of their retirement, discharge, or release from active duty. The evidence of record shows she was a USAR Soldier who was separated from active duty, upon completion of AIT by a...
ARMY | BCMR | CY2012 | 20120019990
The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show her reentry eligibility (RE) code as "1." Pertinent Army regulations provide that individuals will be assigned RE codes prior to discharge or release from active duty based on their service records or the reason for discharge. Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, or...

Facts and Circumstances: Evidence of record shows that on 23 December 2003, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 5-8, AR 635-200, by reason of involuntary separation due to parenthood (in addition to having been AWOL from 14-17 March 2003, failure to be at her appointed place of duty on two occasions and for making a false statement regarding her marital status) with a general, under honorable conditions discharge. The...

The applicant requests in effect, that the reason for his discharge be changed from "In Lieu of Trial by Court-Martial" to "Physical disability." Army Regulation 635-200 (Personnel Separations) sets forth the basic authority for the separation of enlisted personnel. A discharge under other than honorable conditions is normally considered appropriate for a discharge in lieu of court-martial.
