The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that the Purple Heart and the Combat
Infantryman Badge be added to his DD Form 214 (Certificate of Release or
Discharge from Active Duty) for the period ending 3 December 2006.
2. The applicant states, in effect, that the Purple Heart and the Combat
Infantryman Badge were omitted from his DD Form 214 for the period ending
3 December 2006.
3. The applicant provides a copy of his DD Form 214 for the period ending
3 December 2006, a certified copy of a Purple Heart certificate, and
a certified copy of a Combat Infantryman Badge certificate.
CONSIDERATION OF EVIDENCE:
1. The applicant served in Operation Iraqi Freedom.
2. The applicant enlisted in the Army National Guard on 27 January 2001.
He completed basic combat training and advanced individual training and was
awarded military occupational specialty 11B (Infantryman).
3. The applicant was ordered to active duty on 12 October 2003 with his
unit, Company C, 1st Battalion, 186th Infantry.
4. By memorandum dated 6 February 2004, the applicant was awarded the Army
Reserve Components Achievement Medal for the period 27 January 2001 through
26 January 2004.
5. The applicant arrived in Iraq on 15 February 2004. He departed Iraq on
or about 10 July 2004.
6. The applicant provided a certified copy of a Purple Heart certificate
showing he was awarded the Purple Heart on 4 August 2004. The Army
Casualty Operations Division, U. S. Army Human Resources Command confirmed
that the applicant was wounded as a result of enemy action on 9 July 2004.
7. The applicant provided a certified copy of a Combat Infantryman Badge
certificate showing he was awarded the Combat Infantryman Badge on 1 May
2005.
8. On 3 December 2006, the applicant was released from active duty and
retired due to temporary disability. His DD Form 214 for the period ending
3 December 2006 shows he was awarded the National Defense Service Medal,
the Global War on Terrorism Service Medal, the Iraq Campaign Medal, the
Army Service Ribbon, and the Armed Forces Reserve Medal with “M” device.
9. Army Regulation 600-8-22 (Military Awards) provides for award of the
Purple Heart for a wound sustained as a result of hostile action.
Substantiating evidence must be provided to verify that the wound was the
result of hostile action, the wound must have required treatment by a
medical officer, and the medical treatment must have been made a matter of
official record.
10. Army Regulation 600-8-22 provides for award of the Combat Infantryman
Badge to a Soldier who is an infantryman satisfactorily performing infantry
duties, who is assigned to an infantry unit during such time as the unit is
engaged in active ground combat, and who actively participates in such
ground combat.
DISCUSSION AND CONCLUSIONS:
1. The evidence of record shows that the applicant was wounded as a result
of enemy action. Therefore, the certified copy of a Purple Heart
certificate that he provided showing he was awarded the Purple Heart is
accepted as sufficient evidence to show he actually was awarded the Purple
Heart. This award should be added to his DD Form 214 for the period ending
3 December 2006.
2. The applicant provided only a certified copy of a Combat Infantryman
Badge certificate and not orders awarding him the badge. However, the
evidence of record shows he was an infantryman assigned to an infantry unit
and that he was engaged in active ground combat (as evidenced by his being
wounded as a result of enemy action). Therefore, the certified copy of the
Combat Infantryman Badge certificate is accepted as sufficient evidence to
show he actually was awarded the Combat Infantryman Badge. This award
should be added to his DD Form 214 for the period ending 3 December 2006.
3. The evidence of record also shows that the applicant was awarded the
Army Reserve Components Achievement Medal for the period 27 January 2001
through 26 January 2004. This award should also be added to his DD Form
214 for the period ending 3 December 2006.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
amending his DD Form 214 for the period ending 3 December 2006 to add the
Purple Heart, the Combat Infantryman Badge, and the Army Reserve Components
Achievement Medal.
