THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests award of the Army Good Conduct Medal and correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show this award.

2.  The applicant states his unit did not award him the Army Good Conduct Medal.  His record does not contain any negative information and no disciplinary action was taken against him during the 3 years that he served.  He believes he is eligible for award of the Army Good Conduct Medal.  

3.  The applicant provides no additional evidence.

CONSIDERATION OF EVIDENCE:

1.  The applicant's records show he enlisted in the Regular Army on 10 August 2004 and he held military occupational specialty 11B (Infantryman).  He deployed to Iraq from 19 June 2006 to 18 September 2007 while assigned to Company C, 2nd Battalion, 3rd Infantry Regiment, 2nd Infantry Division.

2.  Headquarters, Multi-National Division (Baghdad) Permanent Orders Number 309-403, dated 5 November 2007, awarded him the Purple Heart for wounds received as a result of hostile enemy action on 27 May 2007.

3.  A review of his official military personnel file reveals no derogatory information or any adverse or disciplinary action during his period of military service.

4.  On 20 December 2007, he was honorably released from active duty and transferred to the U.S. Army Reserve Control Group to complete his remaining Reserve obligation in the rank/grade of specialist (SPC)/E-4.  He completed 3 years, 4 months, and 11 days of creditable active service with no lost time.

5.  Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows the Army Commendation Medal, Army Achievement Medal, National Defense Service Medal, Global War on Terrorism Service Medal, Iraq Campaign Medal, Army Service Ribbon, Overseas Service Medal, and Combat Infantryman Badge.

6.  Army Regulation 600-8-22 (Military Awards) provides for the following awards:

	a.  The Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service.  This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service.  Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified.  

	b.  The Iraq Campaign Medal is awarded to members who served in direct support of Operation Iraqi Freedom (OIF).  The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 to a future date to be determined by the Secretary of Defense or the cessation of OIF.  A bronze service star is authorized for wear with this medal for participation in each credited campaign.  Records show during his deployment to Iraq the applicant participated in the following two campaigns:

* National Resolution (16 December 2005-9 January 2007)
* Iraqi Surge (10 January 2007-31 December 2008)

DISCUSSION AND CONCLUSIONS:

1.  The applicant served honorably from 10 August 2004 through 20 December 2007.  He served in Iraq, received an Army Commendation Medal and Army Achievement Medal for meritorious service, attained the rank of SPC, and received a Purple Heart for wounds received in hostile action.  His record is void of any derogatory information that would have disqualified him from receiving the Army Good Conduct Medal (1st Award).  Therefore, it would be appropriate to award him the Army Good Conduct Medal (1st Award) based on completion of a qualifying period of Federal military service and correct his DD Form 214 to show this award.
2.  Permanent orders awarded him the Purple Heart which is not shown on his DD Form 214.  Therefore, he is entitled to correction of his DD Form 214 to show this award.

3.  He participated in two campaigns during his service in Iraq.  Therefore he is entitled to award of two bronze service stars for wear on his already-awarded Iraq Campaign Medal and correction of his DD Form 214 to show this award.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: 

	a.  awarding him the Army Good Conduct Medal (1st Award) for exemplary behavior, efficiency, and fidelity during the period 10 August 2004 through 20 December 2007; 

	b.  deleting from item 13 of his DD Form 214 the Iraq Campaign Medal; and 

	c.  adding to item 13 of his DD Form 214 the Army Good Conduct Medal (1st Award), Purple Heart, and the Iraq Campaign Medal with two bronze service stars.
