                            RECORD OF PROCEEDINGS

      IN THE CASE OF:

      BOARD DATE: 1 March 2007
      DOCKET NUMBER: AR20060011317

I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.

| |Mr. Gerard W. Schwartz | |Acting Director |
| |Mr. Joseph A. Adriance | |Analyst |

The following members, a quorum, were present:

| |Mr. Thomas M. Ray | |Chairperson |
| |Mr. Jeffrey C. Redmann | |Member |
| |Mr. James R. Hastie | |Member |

The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests, in effect, that Item 12d (Total Prior Active
Service) of his 21 April 2006 separation document (DD Form 214) be
corrected to reflect all his prior active service.

2. The applicant states, in effect, that he completed 4 years, 10 months,
and 29 days of prior active service before entering the period of active
duty documented by his 21 April 2006 DD Form 214 (24 October 2004-21 April
2006).

3. The applicant provides DD Forms 214, dated 11 September 1993, 7 August
2003, and 21 April 2006; and a Request for Correction of DD Form 214, dated

13 September 1993, in support of his application.

CONSIDERATION OF EVIDENCE:

1. The applicant's record shows that he is currently serving as a master
sergeant (MSG) in the California Army National Guard (ARNG). It also
confirms that he served on active duty in the Regular Army (RA) for 4
years, from 12 September 1989 through 11 September 1993. Item 12d (Total
Prior Active Service) of the DD Form 214 he was issued upon his release
from active duty (REFRAD) on
11 September 1993, shows he had completed no prior active duty service as
of that date.

2. On 17 August 1993, the applicant completed an In-Service enlistment
contract agreeing to enlist in the ARNG upon his REFRAD on 11 September
1993, and he has continuously served in the ARNG through the present date.

3. On 9 September 2002, while serving as a member of the ARNG, the
applicant entered active duty in support of Operation Noble Eagle. He
served on active duty for 10 months and 29 days until being honorably
REFRAD on 7 August 2003. Item 12d of the DD Form 214 he was issued at the
time shows he had completed 4 years of prior active service as of the date
of his separation,
7 August 2003.

4. On 24 October 2004, while serving as a member of the ARNG, the
applicant was ordered to active duty at Fort Lewis, Washington. He served
on active duty for 1 year, 5 months, and 28 days until being honorably
REFRAD on 21 April 2006. Item 12d of the DD Form 214 he was issued upon
his separation from this period of active duty service contains the entry
"0000 00 00", which indicates he completed no prior active service.

5. Army Regulation 635-5 (Separation Documents) prescribes the separation
documents that must be prepared for Soldiers on retirement, discharge,
release from active duty service, or control of the Active Army. It also
establishes standardized policy for preparing and distributing the DD Form
214. Chapter 2 contains item-by-item preparation instructions of the DD
Form 214. The instructions for Item 12d state that the total amount of
prior active military service, less lost time, taken from previously issued
DD Forms 214 will be entered.

DISCUSSION AND CONCLUSIONS:

The evidence of record confirms that prior to his last period of active
duty service from 24 October 2004 through 21 April 2006, the applicant
completed 4 years of active duty service in the RA from 12 September 1989
through 11 September 1993 and 10 months and 29 days of active duty service
while a member of the ARNG from 9 September 2002 through 7 August 2003.
Therefore, it would be appropriate to correct Item 12d of his 21 April 2006
DD Form 214 to reflect this
4 years, 10 months, and 29 days of prior active military service, as
requested by the applicant.

________ ________ ________ GRANT PARTIAL RELIEF

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
amending Item 12d of his 21 April 2006 DD Form 214 by deleting the current
entry and replacing it with the entry "0004 10 29"; and by providing him
a correction to his separation document that reflects this change.

The evidence of record confirms that the applicant completed 3 months of active duty service completing his ADT between 18 June and 17 September 1976. Further, there is no indication that this active duty service was documented in a DD Form 214 or that it was accounted for in the DD Form 214 issued to the applicant upon his retirement on 30 April 1997. The Board determined that the evidence presented was sufficient to warrant a recommendation for relief and to excuse failure to timely file.
