THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that her DD Form 214 (Certificate of Release or Discharge from Active Duty) be amended to show her correct rank in item 4a (Grade, Rate or Rank).

2.  The applicant states that the DD Form 214 issued to her at Fort Campbell, Kentucky had the wrong rank in item 4a.

3.  The applicant provides a copy of her orders promoting her to staff sergeant (SSG); a copy of her DD Form 214; and a copy of her DD Form 214 from the State Director of Veterans Affairs.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 3 November 1986 and was honorably released from active duty on 6 July 1991 in the rank of specialist.  On the following date, she was transferred to the U.S. Army Reserve (USAR) Control Group (Reinforcement).

2.  The applicant reenlisted in the USAR on 15 October 1995 in pay grade E-4.  She was promoted to sergeant (SGT), E-5 on an unknown date.

3.  She reenlisted in the USAR on 13 October 2001 in pay grade E-5.

4.  The applicant was ordered to active duty in support of Operation Noble Eagle on 17 January 2003.

5.  Headquarters, 81st Regional Support Command, Birmingham, Alabama Orders 03-132-00015, dated 12 May 2003, promoted the applicant from SGT to SSG with an effective date and date of rank (DOR) of 9 May 2003.

6.  The applicant received an Noncommissioned Officer Evaluation Report (NCOER) for the period ending July 2003.  Her rank is shown as “SSG” with a DOR of 9 May 2003.

7.  She completed the Basic Noncommissioned Officer Course, Phase I on 29 April 2004.  Her Service School Academic Evaluation Report shows her rank as “SSG.”  She received a NCOER for the period ending May 2004 which also shows her rank as ‘’SSG” and her DOR as 9 May 2003.


8.  Department of the Army, U.S. Army Human Resources Command, Alexandria, Virginia Orders A-06-405334, dated 8 June 2004, retained the applicant on active duty at Fort Campbell, Kentucky.  These orders show her rank as “SSG.”

9.  The applicant was honorably released from active duty on 29 October 2005 at the completion of her required active service.

10.  The applicant’s DD Form 214 shows her rank as SGT in item 4a and her pay grade as E-5 in item 4b.  Item 12h (Effective Date of Pay Grade) on her DD Form 214 shows the effective date of pay grade as 9 May 2003.

DISCUSSION AND CONCLUSIONS:

1.  Orders show the applicant was promoted to SSG on 9 May 2003.

2.  The applicant’s DD Form 214 for the period ending 29 October 2005 incorrectly reflects her rank and pay grade as SGT, E-5 with an effective date of pay grade of 9 May 2003.  

3.  As a matter of equity, it would be appropriate to amend the applicant’s
DD Form 214 for the period ending 29 October 2005 to show her rank and pay grade as SSG, E-6.

a.  amending item 4a to show the entry “SSG”; and 

	b.  amending item 4b to show the entry “E-6”;
