THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that the Global War on Terrorism Expeditionary Medal (GWOTEM) be removed from his military records. 

2.  The applicant essentially states that his deployment to Kosovo in support of Operation JOINT GUARDIAN was not an authorized area or operation for award of the GWOTEM. 

3.  The applicant provides his DD Form 214 (Certificate of Release or Discharge From Active Duty) in support of this application.

CONSIDERATION OF EVIDENCE:

1.  The applicant is requesting correction of an alleged error which occurred on 
26 February 2005, the date of his release from active duty.  The application submitted in this case is dated 18 May 2006.

2.  Item 18 (Remarks) of the applicantÂ’s DD Form 214 that was issued at the time of his release from active duty on 26 February 2005 shows, in pertinent part, that he was ordered to active duty in support of Operation JOINT GUARDIAN, and that he deployed to Kosovo from 11 October 2003 to 27 December 2004.  However, item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of this same form essentially shows, in pertinent part, that he was awarded both the Kosovo Campaign Medal and the GWOTEM for his deployment to Kosovo.  It should be noted that Operation JOINT GUARDIAN was not an operation associated with the Global War on Terrorism, or part of Operation IRAQI FREEDOM or Operation ENDURING FREEDOM.

3.  Paragraph 2-15 of Army Regulation 600-8-22 (Military Awards), dated 
11 December 2006, provides, in pertinent part, that the Kosovo Campaign Medal is awarded to members of the Armed Forces of the United States who, after 
24 March 1999, participated in or served in direct support of Kosovo Operation(s):  ALLIED FORCE; JOINT GUARDIAN; ALLIED HARBOUR; SUSTAIN HOPE/SHINING HOPE; NOBLE ANVIL; or Kosovo TASK FORCE(S): HAWK; SABER; or HUNTER within the Kosovo Air Campaign or Kosovo Defense Campaign area of eligibility.

4.  Paragraph 2-18 of this same regulation provides guidance on the award of the GWOTEM.  It provides, in pertinent part, that only specific GWOT operations in Kosovo that are not associated with operations qualifying for the Kosovo Campaign Medal qualify a member for award of the GWOTEM.  
DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that the GWOTEM should be removed from his military records. 

2.  The applicant awarded both the Kosovo Campaign Medal and the GWOTEM for his deployment to Kosovo in support of Operation JOINT GUARDIAN, but should only have been awarded the Kosovo Campaign Medal.  Therefore, he is entitled to correction of his military records by removing all entries which show that he was awarded the GWOTEM for his deployment to Kosovo in support of Operation JOINT GUARDIAN.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by removing all entries which show he was awarded the Global War on Terrorism Expeditionary Medal for his deployment to Kosovo in support of Operation JOINT GUARDIAN.
