Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3˙years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant?s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant?s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 26 June 1996, the applicant enlisted in the USAR Delayed Entry Program (DEP) for a period of 8 years. On 2 October 1996, he was discharged from the USAR DEP and on 3 October 1996, he enlisted in the Regular Army for 3 years and 17 weeks. The applicant's DD Form 214 also shows he had 5 months and 1 day of foreign service, but his DD Form 214 does not show the country in which he served. 6. On 1 November 1999, the applicant enlisted in the Florida Army National Guard (FLARNG) for 4 years. He was ordered to active duty in support of Operations Noble Eagle, Enduring Freedom, and Iraqi Freedom, effective 2 January 2003. 7. Information obtained from the Defense Finance and Accounting Service (DFAS) verified that per the applicant's Master Military Pay Account (MMPA), he received hostile fire/imminent danger pay (HF/IDP) and Combat Zone Tax Exemption (CZTE) for service in Albania from 23 April 1999 through 25˙September 1999. All Soldiers on active duty, including Reserve Component Soldiers mobilized, or National Guard Soldiers activated on or after 11˙September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the Global War on Terrorism Service Medal. 14.
