                            RECORD OF PROCEEDINGS

      IN THE CASE OF:

      BOARD DATE: 17 October 2006
      DOCKET NUMBER: AR20060004449

I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.

| |Mr. Carl W. S. Chun | |Director |
| |Mr. Edmund P. Mercanti | |Analyst |

The following members, a quorum, were present:

| |Mr. John T. Meixell | |Chairperson |
| |Mr. Peter B. Fisher | |Member |
| |Mr. Rowland C. Heflin | |Member |

The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests reconsideration of his request to be awarded 2
years constructive service credit for his Master’s Degree in Biomedical
Engineering.

2. The applicant states that the Board only granted him 1 year
constructive service credit because it only looked at the date of his
graduation from undergraduate school (1997) and the date of his graduation
from graduate school (1998). In reality, he started his Master’s Degree in
the Fall Semester of 1996 while he was still working on his undergraduate
degree.

3. The applicant does not provide any additional documentation.

CONSIDERATION OF EVIDENCE:

1. Incorporated herein by reference are military records which were
summarized in the previous consideration of the applicant's case by the
Army Board for Correction of Military Records (ABCMR) in Docket Number
AR20050003057, on 14 February 2006.

2. The applicant’s university transcripts show that he completed
undergraduate courses during the Fall 1993, Spring 1994, Fall 1994, Spring
1995, Fall 1995, Spring 1996, Fall 1996, and Spring 1997 semesters. He was
awarded a Bachelor of Science in Engineering on 18 May 1997.

3. The applicant’s university transcripts show that he was admitted to the
Tulane University Master’s Program in the Fall 1997 semester. He completed
courses during the Fall 1997 and Spring 1998 semesters, and was awarded a
Master of Science in Biomedical Engineering on 17 May 1998.

DISCUSSION AND CONCLUSIONS:

1. The applicant’s university transcripts clearly show that he was
admitted to the Master’s Program in the Fall 1997 semester and was awarded
a Master of Science in Biomedical Engineering on 17 May 1998.

2. As such, the Board appropriately awarded the applicant 1 year
constructive service credit for his Master’s Degree.

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable
error or injustice. Therefore, the Board determined that the overall
merits of this case are insufficient as a basis to amend the decision of
the ABCMR set forth in Docket Number AR20050003057, on 14 February 2006.

Contrary to the OTSG advisory opinion, there does not appear to be a requirement that the applicant be on active duty in order to receive constructive service credit for his advanced degree. As a result, the Board recommends that all Department of the Army records of the individual concerned...
