      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that the award certificate, dated 18 March 2004,
for the Bronze Star Medal (BSM) for meritorious service during the period
21 July 2003 to 15 May 2004 filed in the Commendatory Data section on his
Official Military Personnel File (OMPF) be expunged.

2.  The applicant states there are two BSM award certificates for the same
period of service on his OMPF.  He contends the original award certificate
for the BSM, dated 18 March 2004, was returned for correction of his rank
(sergeant first class instead of staff sergeant) and signed by the incoming
commander on 28 March 2004.  It appears as if there were two award
certificates presented for the same period of service signed by two
different Major Generals.  He contends that he is being considered for
promotion to master sergeant and he has made every effort to correct every
aspect of his military records to remain competitive for promotion.

3.  The applicant provides an award certificate, dated 18 March 2004, for
the BSM for meritorious service during the period 21 July 2003 to 15 May
2004; an award certificate, dated 28 March 2004, for the BSM for
meritorious service during the period 21 July 2003 to 15 May 2004; and a DA
Form 638 (Recommendation for Award), dated 1 January 2004.

CONSIDERATION OF EVIDENCE:

1.  The applicant is currently serving as a sergeant first class assigned
to Headquarters and Headquarters Company, U.S. Army Operational Test
Command, at Fort Hood, Texas.

2.  An award certificate, dated 28 March 2004, shows the applicant was
awarded the BSM for meritorious service during the period 21 July 2003 to
15 May 2004 in Afghanistan.  This certificate was authenticated by the
Commanding General
(a Major General) of the U.S. Army.

3.  Review of the applicant's OMPF revealed two BSM award certificates for
meritorious service for the same period of service.  The first award
certificate, dated 18 March 2004, filed in the Commendatory Data section on
his OMPF contains an error in the applicant's rank (staff sergeant).  The
second award certificate, dated 28 March 2004, filed in the Commendatory
Data section on his OMPF appears to be a "corrected copy" of the first
award certificate since his rank was corrected to show sergeant first
class.


DISCUSSION AND CONCLUSIONS:

The applicant received the BSM for meritorious service during the period 21
July 2003 to 15 May 2004.  The BSM award certificate, dated 18 March 2004,
filed in the Commendatory Data section of the applicant's OMPF contains an
incorrect rank.  This error was corrected and a new award certificate for
the BSM was published on 28 March 2004 and filed in the Commendatory Data
section on his OMPF.  Therefore, it would be appropriate to expunge the BSM
award certificate, dated 18 March 2004, contained in this section on his
OMPF.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief.  As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
removing the award certificate, dated 18 March 2004, for the BSM for
meritorious service filed in the Commendatory Data section on the
applicant's OMPF.
