The Board considered the following evidence:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that Item 13 (Decorations, Medals,
Badges, Citations and Campaign Ribbons Awarded or Authorized) and Item 14
(Military Education) of his separation document (DD Form 214) be corrected.
2. The applicant states, in effect, that Item 13 of his DD Form 214 should
include the Meritorious Service Medal (MSM) 1st Oak Leaf Cluster,
Parachutist Badge, Senior Aircraft Crewmember Badge, and Global War on
Terrorism Service Medal (GWOTSM). He also indicates that Item 14 should
include the Airborne Course and Master Driver Course. He claims that these
awards and schools were overlooked when he out-processed, and the MSM 1st
Oak Leaf Cluster and GWOTSM were given to him at his retirement ceremony
after he had completed processing.
3. The applicant provides the following documents in support of his
application: DD Form 214; MSM Certificate, dated 4 March 2004;
Recommendation for Award (DA Form 638); Airborne Course Certificate, dated
19 November 1999; Parachutist Badge Orders, dated 7 November 1999; Senior
Aircraft Crewmember Badge Orders, dated 3 November 1998; and Master Driver
Course Certificate, dated 18 June 1993.
CONSIDERATION OF EVIDENCE:
1. The applicant’s record shows that on 31 May 2004, he was honorably
released from active duty (REFRAD) for the purpose of retirement, in the
rank of master sergeant (MSG), after completing a total of 24 years, 6
months, and
11 days of active military service.
2. The DD Form 214 issued to the applicant upon his REFRAD on 31 May 2004,
contains the following list of awards in Item 13: Army Achievement Medal
(3); MSM; Air Medal; Army Commendation Medal (4); Joint Meritorious Unit
Award (5); Army Good Conduct Medal (7); National Defense Service Medal (2);
Korea Defense Service Medal; Armed Forces Expeditionary Medal with
arrowhead device; Armed Forces Expeditionary Medal; Noncommissioned Officer
Professional Development Ribbon with Numeral 3; Army Service Ribbon;
Overseas Service Ribbon (2); Aircraft Crewman Badge; Air Assault Badge; and
Driver and Mechanic Badge.
3. The list of courses and schools entered in Item 14 of the applicant’s
DD Form 214 does not include the Basic Airborne Course or the Master Driver
Course.
4. The applicant’s Official Military Personnel File (OMPF) contains an MSM
Certificate that confirms that on 20 November 1991, he was awarded the MSM
for meritorious service, for the period 21 May 1989 through 19 November
1991. The applicant provides a DA Form 638 that confirms he was awarded
the MSM 1st Oak Leaf Cluster on 4 March 2004, for his meritorious service
for the period
1 June 1994 through 31 May 2004. This award was approved and announced in
Headquarters, United States Army Special Operations Command Orders Number
064-3 on 4 March 2004.
5. The applicant also provides Headquarters, 101st Airborne Division
Permanent Orders Number 307-151, dated 3 November 1998, which awarded him
the Senior Aircraft Crewmember Badge, effective 3 November 1998. He also
provides United States Army Infantry Center (USAIC) Permanent Orders Number
311-389, dated 7 November 1999, which awarded him the Parachutist Badge,
effective 17 November 1999; and an Airborne Course Certificate, dated
19 November 1999, which confirms he successfully completed the airborne
course. The applicant also provides a Certificate of Training that shows
he completed a 20-hour Master Driver Course at Camp Stanley, Korea on 18
June 1993.
6. Army Regulation 600-8-22 (Military Awards) prescribes Army policy and
criteria concerning individual military awards. Paragraph 8-11 contains
guidance on award of the basic Parachutist Badge. It states that to be
eligible, an individual must have satisfactorily completed the prescribed
proficiency tests while assigned or attached to an airborne unit or the
Airborne Department of the Infantry School.
7. Paragraph 8-26 of the awards regulation contains guidance on award of
the Senior Aircraft Crewmember Badge. It states, in pertinent part, that
it is awarded to an individual on flight status who served in one or more
of the following positions: crew chief; airborne electronic sensory system
operators or supervisor; flight engineer; observer; aeromedical physician
assistant; medical aid person; gunner; aircraft maintenance supervisor; or
technical inspector. It further states, in pertinent part, that effective
1 January 1993, Soldiers may qualify for the Senior Aircraft Crew Member
Badge for 10 years of experience (not necessarily consecutive) in one or
more of the positions listed above. Soldiers in career management field
(CMF) 67 and 68 military occupational specialties may also qualify for the
badge after 10 years of service in the CMF.
8. Human Resources Command Message (Date Time Group 17 March 2004)
disseminated implementing instructions for award of the GWOTSM. This award
is designated for Soldiers who have participated in or served in support of
Global War on Terrorism (GWOT). All Soldiers on active duty, including
Reserve Component Soldiers mobilized or National Guard Soldiers activated,
on or after 11 September 2001 to a date to be determined having served 30
consecutive days or 60 nonconsecutive days are authorized this award.
9. Army Regulation 635-5 (Separation Documents) prescribes the separation
documents that must be prepared for Soldiers on retirement, discharge,
release from active duty service, or control of the Active Army. It also
establishes standardized policy for preparing and distributing the DD Form
214. Chapter 2 contains item-by-item preparation instructions. The
instructions for Item 13 are to list awards and decorations for all periods
of service as verified from the Soldier’s records.
10. The instructions contained in the separation documents regulation for
Item 14 of the DD Form 214 are to list formal in-service (full-time
attendance) training courses successfully completed during the period of
service covered by the DD Form 214. (As an exception to full-time
attendance, list Command and General Staff College and Senior Service
Colleges completed by correspondence courses.). This information is to
assist the Soldier in job placement and counseling; therefore, do not list
training courses for combat skills.
DISCUSSION AND CONCLUSIONS:
1. The evidence of record confirms the applicant was awarded the MSM 1st
Oak Leaf Cluster in conjunction with his retirement. His record also
confirms he was awarded the Parachutist Badge upon completion of the basic
Airborne Course at the USAIC, and the Senior Aircraft Crewmember Badge by
the 101st Airborne Division. Therefore, it would be appropriate to add
these earned awards to Item 13 of his DD Form 214 at this time.
2. The record also confirms the applicant served on active duty on and
after
11 September 2001. As a result of this qualifying active duty service, he
is entitled to the GWOTSM, and it should also be added to his separation
document at this time.
3. The applicant’s record further shows he completed the Airborne Course
at the USAIC on 19 November 1999. Therefore, it would be appropriate to
add this course to Item 14 of his DD Form 214.
4. There are no regulatory provisions that allow for entering installation
driving courses, such as the course the applicant completed at Camp
Stanley, Korea in 1993 to Item 14 of the DD Form 214. Therefore, it would
not be appropriate to grant this portion of the relief requested by the
applicant.

BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief and to excuse failure to timely
file. As a result, the Board recommends that all Department of the Army
records of the individual concerned be corrected by amending his 31 May
2004 DD Form 214 by adding the Meritorious Service Medal 1st Oak Leaf
Cluster, Parachutist Badge, Senior Aircraft Crewmenber Badge, and Global
War on Terrorism Service Medal to
Item 13, and by adding the entry “Airborne Course, 3 weeks, 1999” to Item
14; and by providing him a correction to his separation document that
includes these changes.
2. The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief. As a result,
the Board recommends denial of so much of the application that pertains to
adding the Master Driver Course to Item 14 of his DD Form 214.
