THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Combat Action Badge (CAB) and two awards of the Army Achievement Medal (AAM).  Additionally, he requests that his Basic Combat Training Course and Airborne Course be added to his DD Form 214.
 
2.  The applicant states, in effect, that the above awards and courses were never added to his DD Form 214.

3.  The applicant provides a copy of his DD Form 214; two AAM certificates; Headquarters, Multi-National Division (Baghdad), Camp Liberty, Iraq Permanent Orders 220-092, dated 8 August 2007, for the CAB; Basic Combat Training Course Diploma, dated 2 November 2006; and Airborne Course Diploma, dated 16 February 2007, in support of his application.

CONSIDERATION OF EVIDENCE:

1.  The applicant’s records show he enlisted in the Regular Army (RA) on
22 August 2006.  He was subsequently discharged on 2 June 2008 with an administrative discharge.

2.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 shows the Global War on Terrorism Service Medal and the Army Service Ribbon.  However, it does not show that he was awarded the CAB or any awards of the AAM.
3.  The applicant's diploma from the U.S. Army Field Artillery Training Center, Fort Sill, OK, shows that on 2 November 2006 he successfully graduated from the Basic Combat Training Course, Class Number 514-06.
 
4.  The applicant's diploma from the U.S. Army Infantry School, Fort Benning, GA, dated 16 February 2007, shows that on 16 February 2007 he successfully completed the Airborne Course.  Additionally, Headquarters, U.S. Army Infantry Center, Fort Benning, Permanent Orders 40-2803, dated 9 February 2007, contained in the applicant's records, show he was awarded the Parachutist Badge for successful completion of Airborne training.  The date(s) or period of service on this order shows the entry "16 February 2007 or upon completion of Airborne training."  The established period for completion of Airborne training is
3 weeks.

5.  Permanent Orders 220-092, dated 8 August 2007, show that the applicant was awarded the Combat Action Badge.

6.  Headquarters, 1st Battalion, 325th Parachute Infantry Regiment (PIR), Fort Bragg, NC, Permanent Orders 258-150, dated 15 September 2007, show the applicant was awarded the AAM for exceptionally meritorious service while serving as a wheeled driver from 12 April 2007 to 11 November 2007 in support of Operation Iraqi Freedom.

7.  The same headquarters issued Permanent Orders 269-02, dated
26 September 2007, that show the applicant was awarded the AAM for exceptional meritorious achievement while serving as a driver during a medical operation (MEDOP).

8.  Item 14 (Military Education) of the applicant's DD Form 214 shows he completed an 8-week Motor Transport Operator's Course in 2007. 

9.  A review of the applicant's Enlisted Record Brief (ERB) shows in Section VI (Military Education) that he completed the Airborne Course in 2007.  Section VIII (Awards and Decorations) show award of the National Defense Service Medal, Global War on Terrorism Service Medal, Army Service Ribbon, and Combat Action Badge.

10.  Army Regulation 635-5 (Personnel Separations - Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It establishes standardized policy for the preparation of the DD Form 214.  It states that awards and decorations for all periods of service in the priority sequence specified in Army Regulation 600-8-22 will be entered on the DD Form 214.  Each entry will be verified by the Soldier’s records.

11.  Army Regulation 635-5 further states, in pertinent part, to list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214 in item 14 to include title, length in 
weeks, and year completed.  This information is to assist the Soldier in job placement and counseling; therefore, do not list training courses for combat skills.

12.  Army Regulation 600-8-22 (Military Awards) states, in pertinent part, that an oak leaf cluster is awarded to denote the second and succeeding awards of certain decorations, among which is the AAM.

13.  Army Human Resources Command Military Personnel (MILPER) Message Number 08-123 provides the guidance and criteria, applicability and standards on awarding and wear of service stars on the Iraq Campaign Medal (ICM).  It states, in pertinent part, that one bronze service star will be worn on the ICM for one or more days of participation in each designated campaign phase.  Approved designated ICM campaign phases and inclusive periods are listed below:

Liberation of Iraq/19 Mar 2003 - 1 May 2003 
Transition of Iraq/2 May 2003 - 28 Jun 2004 
Iraq Governance/29 Jun 2004 - 15 Dec 2005 
National Resolution/16 Dec 2005 – Date to be determined

DISCUSSION AND CONCLUSIONS:

1.  Permanent Orders 220-092 awarded the applicant the CAB for actively engaging or being engaged by the enemy on 23 July 2007.  Therefore, his records should be corrected to show this award.

2.  Permanent Orders 258-150 and 269-02 awarded the applicant two awards of the AAM.  Therefore, his records should be corrected to show the AAM with 1st oak leaf cluster.

3.  The applicant’s submitted diploma verifies that he successfully completed the Basic Combat Training Course on 2 November 2006.  However, this was a combat skills training course and does not meet the criteria for addition to his DD Form 214.  Therefore, there is no basis for adding this course to item 14 of his DD Form 214.

4.  The applicant's submitted diploma verifies that he successfully completed the Airborne Course on 16 February 2007.  Therefore, his records should be corrected to show he successfully completed the 3-week Airborne Course in 2007.

5.  Orders show that the applicant was awarded the Parachutist Badge on
16 February 2007 based on successful completion of Airborne training.  Therefore, his records should be corrected to show award of the Parachutist Badge.

6.  The applicant's ERB shows entitlement to the National Defense Service Medal and the Iraq Campaign Medal which are not shown on his DD Form 214.  Therefore, his DD Form 214 should be corrected to show these awards.

7.  Records also show that he participated in the National Resolution campaign phase during his tenure of service in Iraq.  Therefore, he is entitled to one bronze service star for wear on his Iraq Campaign Medal.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
   
   a.  adding to item 13 of his DD Form 214 the Army Achievement Medal with 1st oak leaf cluster, National Defense Service Medal, Iraq Campaign Medal with one bronze service star, Combat Action Badge, and Parachutist Badge; and
   
   b.  adding to item 14 of his DD Form 214 the entry "Airborne Course, 
3 Weeks, 2007."


2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to adding to item 14 of his DD Form 214 the Basic Combat Training Course.
