         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the third award of the Army Achievement Medal.

3. The applicant states, in effect, that the third award of the Army Achievement Medal should be added to his DD Form 214.

4. The applicant submitted three DA Forms 638 (Recommendation for Award) and orders awarding him the Army Good Conduct Medal and the Mechanics Badge in support of his application.

5. The applicant’s military records show that he enlisted in the Regular Army
on 9 September 1996. He completed the required training and was awarded military occupational specialty 52D (Power Generation Equipment Repairer).

6. The applicant was honorably released from active duty on 8 September 1999 at the completion of his required active service. His DD Form 214 shows the Army Achievement Medal (2nd Award) as an authorized award.

7. The applicant provided a DA Form 638 dated 2 August 1999. This document shows he was recommended for award of the Army Achievement Medal (3rd Award) as an end of tour award for meritorious service for the period 27 March 1998 to 9 September 1999. Part V (Orders Data) of this DA Form 638 shows he was issued award of the Army Achievement Medal based on 548th Corps Support Battalion, Fort Drum, New York Permanent Orders Number 280-02 dated 14 October 1999.

CONCLUSIONS:

1. The evidence of record shows the applicant was awarded a third award of the Army Achievement Medal. Therefore, his records should be corrected to show the Army Achievement Medal (3rd Award).

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.










RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by adding award of the Army Achievement Medal (3rd Award).
