PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 21 October 2002, DA, HQ, 101 st Airborne Division (Air Assault), Fort Campbell, Kentucky, Orders 294-0010 released the applicant from the Regular Army, effective date 30 October 2002. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty). His DD Form 214 indicates that he was released under the provisions of Chapter 13, AR 635-200 by reason of physical standards, with a characterization of service of general, under honorable conditions and transferred to the Individual Ready Reserves (IRR). The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 30 October 2002, the applicant was released. At the time of release, the applicant had completed 4 years, 5 months, and 9 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the requirements and procedures for administrative discharge of enlisted personnel. Chapter 13 of this regulation, states in pertinent part, that separation proceedings will be initiated for soldiers without medical limitations who have two consecutive failures of the Army Physical Fitness Test. The reason for discharge will be shown as unsatisfactory performance. Service of soldiers separated because of unsatisfactory performance for failure of the Army Physical Fitness Test will be characterized as honorable or general, under honorable conditions.

(1) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The Board noted that the applicant was released from active duty for the sole reason of a failure to meet the minimum standards on the Army Physical Fitness Test and transferred to the individual ready reserves (IRR). The Board also noted the overall length and quality of the applicant’s service. Based on these factors, the Board determined that the characterization of service was inequitable. Accordingly, the Board voted to grant relief by changing the characterization of service to fully honorable.
