PART IV - PREHEARING REVIEW
SECTION A-ANALYSTS ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 25 September 2001, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of homosexual admission, with an honorable discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement in his own behalf. The unit commander subsequently recommended separation from the service and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with an honorable discharge. On 26 September 2001, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a characterization of service of honorable.
b. On 2 October 2001, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, 1 month, and 10 days of active military service in the period under review.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 15 of that regulation states that active homosexuality is incompatible with military service and provides, in pertinent part, for the separation of members who actively engage in homosexual conduct or who, by their statements, demonstrate a tendency to engage in homosexual conduct.

a. Propriety: The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1) The issue is rejected. The Board carefully examined the applicants record of service during the period of enlistment under review. The evidence of record shows that the applicant voluntarily admitted to being a bisexual and having a natural propensity to engage in sexual activity with members of the same sex. Subsequent to the applicants admission, his commanding officer properly initiated separation action under the provisions of Chapter 15, AR 635-200 by reason of homosexual admission with an honorable characterization of service. The Board noted the applicants contentions; however, did not find said contentions sufficiently mitigating to warrant a change in the narrative reason for separation. The Board was satisfied that all requirements of law and regulations were met and the rights of the applicant were fully protected throughout the separation process. Furthermore, a change to the reentry eligibility (RE) code does not fall within the purview of this Board. The Board noted that the applicant was properly assigned an RE Code of 4. RE Code 4 simply means that the applicant was discharged with a disqualification that may not be waived and is therefore ineligible for reenlistment. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
