         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that item 11 (Primary Specialty) on his 2002 Department of Defense Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show that he held specialty 52C10 (Utility Equipment Repairer) vice 92Y10 (Unit Supply Specialist) and that item 14 (Military Education) be corrected to show completion of the Utility Equipment Repairer Course. He makes no statement and submits no evidence in support of his request.

3. Records available to the Board indicate that the applicant enlisted in the United States Army Reserve for a period of 8 years in January 1998. He entered active duty on 12 February 1998 for the purpose of undergoing training. He completed a 15-week Utility Equipment Repairer Course and was awarded a primary specialty of 52C10 prior to be released from active duty on 15 July 1998. His 1998 separation document reflects completion of the Utility Equipment Repairer Course and that his specialty at the time of separation was 52C10.

4. On 6 October 1999 the applicant enlisted in the Regular Army for a period of 3 years. Included as part of his enlistment contract was utilization in his prior specialty of 52C with no additional training requirements.

5. The applicant completed his 3 year enlistment contract and was released from active duty on 5 October 2002. His records contain no evidence that he was ever awarded a new specialty of 92Y (Unit Supply Specialist) or that he completed training for reclassification purposes. However, his October 2002 separation document indicates that he had served 3 years in specialty 92Y rather than in specialty 52C.

6. The applicant did not complete any training during his 3-year enlistment contract and as such item 14 (Military Education) reflects “None.”

7. Army Regulation 635-5 establishes the policies and provisions for the preparation of the Department of Defense Form 214. It states, in pertinent part, that item 11 (Primary Specialty) will reflect the titles of all military occupational specialties (MOS) served in by the Soldier for at least 1 year. It notes that for enlisted Soldiers the first 5 characters of the primary MOS, the title, and the number of years and months served will be recorded. Time spent in basic and advanced individual training is not included in the number of years and months in which the Soldier served in the specialty.

8. The regulation states that item 14 (Military Education) will reflect formal in-service training courses successfully completed during the period of service covered by the Department of Defense Form 214.



CONCLUSIONS
:

1. The information concerning completion of the Utility Equipment Repairer Course is properly recorded on the separation document which was issued to the applicant upon his release from active duty in July 1998. Because the course was not completed during the period of service captured on his October 2002 separation document it would not be recorded in item 14 on that form.

2. There is no indication that the applicant was ever trained, awarded, or worked in specialty 92Y (Unit Supply Specialist) during his 3-year enlistment between 1999 and 2002. The evidence, which is available, tends to support a conclusion that the applicant continued to serve in the 52C10 Utility Equipment Repairer specialty he was awarded while a member of the United States Army Reserve. As such, the Board concludes that it would be appropriate, and in the interest of justice, to correct his 2002 separation document to reflect 52C10 Utility Equipment Repair, vice the 92Y10 Unit Supply Specialist, currently shown. The Board notes that the service period of 3 years in item 14 is correct, in spite of the error in the specialty and title.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing in item 11 that the applicant served 3 years in specialty 52C10 Utility Equipment Repair vice 92Y10 Unit Supply Specialist.

2. That so much of the application as is in excess of the foregoing be denied.
