         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his Armed Forces of the United States Report of Transfer or Discharge (DD Form 214) for the period ending 31 October 1972 be corrected to show that his branch in Item 4 (Department, Component, and Branch or Class) as Infantry and not Armor; that he was awarded the Purple Heart with two oak leaf clusters (PH/2OLC) in Item 24 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized); and that Item 30 (Remarks) reflect that he did serve in the Korean War (Korea - Yes).

3. The applicant states that at the time of his retirement, the clerks were handling an extremely large volume of work and omissions/errors were common. He believes the errors to be unintentional and would like them corrected. In support of his application, he submits a copy of his DD Form 214 for the period ending 31 October 1972 and a copy of the United States Army Surgeon General Office Hospitalization File Listing 1950-53 (Korea).

4. The applicant’s military records show that he enlisted in the Regular Army on 8 June 1950 for a period of 3 years. Following all required military training, he was awarded military occupational specialty (MOS) 111.60, Light Weapons Infantryman. He was immediately reassigned to Korea as his first permanent duty assignment, arriving there on/about 21 October 1950. He served in Korea with the 15th Infantry Regiment, 2nd Infantry Division until on/about 18 January 1952, participating in 6 campaigns.

5. The applicant's records show that he was awarded the following medals for his Korean War service: Bronze Star Medal (BSM) with "V" Device; the Purple Heart with OLC; the National Defense Service Medal (NDSM); the Korean Service Medal (KSM) with 1 Silver Service Star (SSS) and 1 Bronze Service Star (BSS); the United Nations Service Medal (UNSM); and the Combat Infantryman Badge (CIB).

6. On 8 June 1953, the applicant reenlisted and served continuously through a series of reenlistments until he retired from active duty on 31 October 1972.

7. The applicant served in Vietnam with the US Military Assistance Command, Vietnam (MACV) from 1 March 1966 to 20 September 1967, and again from 7 April 1968 to 2 February 1972, participating in a total of 7 campaigns. His records show that he was awarded the following medals during his Vietnam service: the BSM with OLC, the PH, the Army Commendation Medal (ARCOM) with OLC, the NDSM (2nd award); the Vietnam Service Medal (VSM) with 1 SSS and 2 BSS; the Vietnam Campaign Medal with 1960 Device; the Republic of Vietnam Staff Service Medal, 2nd Class (2 awards), and the CIB.

8. The applicant was honorably separated by reason of retirement on 31 October 1972 at Fort Hood, Texas. He was retired in the rank of First Sergeant (1SG/E-8) with 22 years, 4 months, and 23 days of creditable active Federal service. His final DD Form 214 lists the following awards and decorations in Item 24: "3 Bronze Service Stars to Vietnam Service Medal; Combat Infantryman Badge (2d Awd); Good Conduct Medal, Clasp, Silver, 1 Loop; Third Oak Leaf Cluster to Bronze Star Medal; Vietnamese Staff Service Medal, 2nd Class; Expert (Pistol); Expert (Rifle); First Oak Leaf Cluster to Army Commendation Medal; Expert (M79 GL).

9. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the unit awards received by units serving in Vietnam. Department of the Army General Orders (DAGO) 8, dated 1974, announced award of the Vietnam Gallantry Cross with Palm Unit Citation for Headquarters, United States Military Assistance Command and its subordinate units during the period 8 February 1962 to 28 March 1973. In addition, MACV was awarded the Meritorious Unit Commendation (MUC) during the period 8 March 1965 to 31 August 1967 by DAGO 10, dated 1968.

CONCLUSIONS:

1. The evidence of record confirms that the applicant served in the Infantry Branch, not the Armor Branch as was indicated on his DD Form 214. It also confirms that he was twice wounded during the Korean War and was wounded once during the Vietnam War; there is an order, dated 3 April 1970, awarding him the PH (2OLC) for wounds received in action on 1 April 1970.

2. The evidence of record confirms that the applicant served in Korea from 21 October 1950 to 18 January 1952 and again between 19 June 1954 and 19 November 1958; however, it is not reflected on his DD Form 214.

3. The applicant's retirement DD Form 214 does not properly reflect all awards and decorations to which he is entitled. It should reflect the following: BSM with "V" Device and 2OLC; PH with 2OLC; ARCOM with OLC, GCMDL with Clasp, Silver, 1 Loop; NDSM with BSS; KSM with SSS and BSS; VSM with SSS and 2 BSS; UNSM; VCM with 1960 Device; MUC; Vietnam Gallantry Cross with Palm Unit Citation; Republic of Vietnam Staff Service Medal, 2nd Class (2nd Award); CIB (2nd Award); Expert Marksmanship Badge (Pistol, Rifle, M79).

4. Because of the numerous changes required to the applicant's retirement DD Form 214, the Board recommends that, as an exception to policy, the applicant be issued a new DD Form 214 rather than a DD Form 215 (Correction to DD Form 214).

5. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION
:

That all of the Department of the Army records related to this case and the individual concerned be corrected by:

a. Voiding his DD Form 214, dated 31 October 1972, and issuing to him a new DD Form 214;

         b. Showing in Item 2 (Department, Component, and Branch), "ARMY / RA / IN;"

         c. Showing in Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized), "Bronze Star Medal with "V" Device and 2OLC; Purple Heart with 2OLC; Army Commendation Medal with OLC, Good Conduct Medal with Clasp, Silver, 1 Loop; National Defense Service Medal with Bronze Service Star; Korean Service Medal with Silver Service Star and Bronze Service Star; Vietnam Service Medal with Silver Service Star and 2 Bronze Service Star; United Nations Service Medal; Vietnam Campaign Medal with 1960 Device; Meritorious Unit Commendation; Vietnam Gallantry Cross with Palm Unit Citation; Republic of Vietnam Staff Service Medal, 2nd Class (2nd Award); CIB (2nd Award); Expert Marksmanship Badge (Pistol, Rifle, M79);"
