         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that the Good Conduct Medal and the Army Achievement Medal be shown on her DD Form 214 (Certificate of Release or Discharge from Active Duty).

3. The applicant states, in effect, that the enclosed copy of the recommendation for the Army Achievement Medal shows that it was awarded.

4. The applicant’s military records show that she enlisted on 14 July 1997 and served until 13 July 2000 when she was separated with an honorable characterization of service at the completion of her required active service. She was transferred to the Army Reserve in pay grade E-3. There is no discreditable information of record.

5. Army Regulation 600-8-22 provides that the Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. A record of punishment is not automatically disqualifying. Although there is no automatic entitlement to the Good Conduct Medal, disqualification must be justified. Current practice requires that the commander provide written notice of non-favorable consideration and permits the individual to respond.

6. The copy of the completed and signed Recommendation for Award (DA Form 638) specifically praised the applicant's professional competence and noted her ability to adapt, military bearing and appearance; attention to detail and safety awareness. The recommendation carries the headquarters order number and signature of the approving officer, the battalion commander. The applicant was awarded the Army Achievement Medal for meritorious service for the period 15 January 1998 to 12 January 1999.

CONCLUSIONS:

1. The applicant was awarded the Army Achievement Medal and that award should be listed on her DD Form 214.

2. She distinguished herself by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service as evidenced by her offense free record, the recommendation for the Army Achievement Medal and honorable discharge. She should be awarded the Good Conduct Medal for the period 14 July 1997 to 13July 2000 and it should be shown on her DD Form 214.


3. In view of the foregoing findings and conclusions, correcting the applicant’s records as recommended below will correct errors.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the awards of the individual concerned include the Good Conduct Medal and the Army Achievement Medal.
