         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his Certificate of Release or Discharge from Active Duty, DD Form 214, be corrected to show he completed the 97B20 military occupational specialty (MOS) course and that he held MOS 97B20 (skill level 2).

3. The applicant states that the error on his DD Form 214 was probably caused by his unorthodox assignment to the Defense Investigative Service (DIS) and the nature of the split 97B10/20 course. The idea was that the soldier would attend the 97B10 course and then be assigned to a tactical position in a military intelligence company. After one year, the agent would then attend the 97B20 course and be assigned to a strategic office. He was assigned to DIS in lieu of a strategic office assignment. To his knowledge, 97B10 was never a primary MOS. It was a temporary designator until such time as the 97B20 course was completed.

4. The applicant’s military records show that he enlisted in the Regular Army on 27 October 1981. He completed basic training and advanced individual training and was awarded MOS 97B10 (Counterintelligence Agent) in 1982.

5. The applicant attended the Counterintelligence Agent (Transition) 97B20 course from 8 July - 1 September 1983. He was assigned to the U. S. Army Element, DIS with duty station Santa Rosa, CA on 19 September 1983 and performed duties in MOS 97B20.

6. The applicant was promoted to Specialist Four, E-4 on 16 November 1983 in MOS 97B10.

7. The applicant was released from active duty on 26 October 1984. Item 11 of his DD Form 214 shows he held MOS 97B10 for 2 years and 5 months. Item 14 of his DD Form 214 shows he completed the Counterintelligence Agent course in May 1982 and no other military courses.

8. Army Regulation 611-201 provides the enlisted MOS classification structure for the Army. Effective 1 January 1974, the career management fields were standardized by having a fixed grade-skill level relationship. A direct relationship was established between grade and skill level without regard to nonsupervisory and supervisory skills. Skill level 1 identifies positions authorized grades E-3 and E-4. Skill level 2 identifies positions authorized grade E-5.

9. Army Regulation 600-200 prescribes policies for the classification and reclassification of enlisted soldiers in an MOS. It states that there is a direct relationship between rank and skill level and soldiers will not have a skill level other than that specified by the regulation. Skill level 1 is authorized for privates through corporals/specialists; skill level 2 is authorized for sergeants.

CONCLUSIONS:

1. There is an error on the applicant's DD Form 214. He completed the 8-week Counterintelligence Agent (Transition) course in September 1983. It is not listed on his DD Form 214 but should be added.

2. Item 11 of the applicant's DD Form 214 properly shows he held MOS 97B10. Although he may have completed a skill level 2 training course, as an E-4 he was not authorized award of a skill level 2 with his MOS. There is no evidence of record to show he was awarded 97B20; such an award would have been in error.

3. In view of the foregoing, the applicant’s records should be corrected but only as recommended below.

RECOMMENDATION:

1. That the applicant's DD Form 214 be amended to show he completed the 8-week Counterintelligence Agent (Transition) course in September 1983

2. That so much of the application as is in excess of the foregoing be denied.
