         The Board, established pursuant to authority contained in 10 U.S.C. 1552, convened at the call of the Chairperson on the above date. In accordance with Army Regulation 15-185, the application and the available military records pertinent to the corrective action requested were reviewed to determine whether to authorize a formal hearing, recommend that the records be corrected without a formal hearing, or to deny the application without a formal hearing if it is determined that insufficient relevant evidence has been presented to demonstrate the existence of probable material error or injustice.

         The applicant requests correction of military records as stated in the application to the Board and as restated herein.

         The Board considered the following evidence:

APPLICANT REQUESTS: In effect, that his military records be changed to show his correct social security account number (SSAN).

APPLICANT STATES: In effect, that the SSAN shown in Item 3 (Social Security No.) of his DD Form 214 is incorrect. He claims that it should be corrected to reflect the same number that is on file with the Social Security Administration and that is entered in his application to this Board. In support of his application, he submits a verification form from the Social Security Administration, a copy of his SSAN card, and his separation document (DD Form 214)

EVIDENCE OF RECORD: The applicant's military records show:

On 4 August 1989, the applicant was honorably discharged from the Army under the provisions of paragraph 4-24e, Army Regulation 635-40, by reason of physical disability with severance pay. At the time of his discharge, he had completed a total of 2 years, 6 months, and 2 days of active military service.

The applicant was issued a DD Form 214 on the date of his separation,
4 August 1989. He authenticated this document with his signature and it confirms that he held the rank of specialist four/E-4 at that time. This document also shows that he was trained and served in military occupational specialty (MOS) 51B (Carpentry/Masonry Specialist) during his active duty tenure.

The SSAN recorded in the applicant’s enlistment contract, the service record created on him at the time of his enlistment, and in the records and documents prepared and published throughout his active duty tenure, is consistent with the one recorded in his separation document.

The applicant provides a letter from the Office Manager of the Bryan, Texas, Social Security Administration Branch Office. This letter verifies that the applicant was using a wrong SSAN and it provides the applicant’s correct SSAN. However, it did not provide confirmation on why the applicant used the SSAN he did during his tenure on active duty, and why this SSAN is different from the one he now possesses.

DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:

1. The Board notes the applicant’s contention that the SSAN recorded in his military records and in documents prepared and published throughout his active duty service is incorrect. However, it finds insufficient evidence that suggests the SSAN recorded in his military records was in error at the time he served.

2. Although the letter from Social Security Administration provided by the applicant confirms his correct SSAN, which is different than the one under which he performed his military service. The applicant provides no explanation for why his current SSAN is different from the one recorded in his military records. Therefore, the Board finds an insufficient evidentiary basis for providing the requested relief.

3. The Army has an interest in maintaining the accuracy of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created. In this case, the applicant has provided no evidence to suggest that the SSAN listed in his records was in error while he was performing his military service, or that maintaining this SSAN in his records would cause him any injustice. Thus, the Board finds insufficient evidence to support granting the requested relief.

4. In view of the foregoing, there is no basis for granting the applicant's request.

DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
