PROCEEDINGS

         IN THE CASE OF:

         BOARD DATE: 30 MAY 2002
         DOCKET NUMBER: AR2002071038

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
Ms. Deborah L. Brantley Senior Analyst

The following members, a quorum, were present:

Mr. Raymond V. O’Connor, Jr. Chairperson
Mr. John P. Infante Member
Ms. Paula Mokulis Member

The applicant and counsel if any, did not appear before the Board.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2. The applicant requests that the separation date on his WD AGO Form 53-55 (Enlisted Record and Report of Separation) be corrected. He notes that the separation date currently reflected is the same as his date of birth.

3. The applicant's records were apparently lost or destroyed during the 1973 fire at the National Personnel Records Center in St. Louis. Information contained herein was reconstructed from alternative sources.

4. He entered active duty on 26 June 1946. His WD AGO Form 53-55 indicates his date of birth as 12 February 1926. His final payment voucher indicates that he was discharged on 20 May 1947, which is consistent with the dates he was on "terminal leave" recorded in the remarks section of his separation document. Item 7 (date of separation) on his WD AGO Form 53-55, however, indicates he was separated on 12 February 1926, the same date as his date of birth.

CONCLUSIONS:

1. The Board concludes that the separation date currently reflected on the applicant's separation document is erroneous. There is sufficient evidence, in the form of a final payment voucher and dates of terminal leave recorded on his separation document, to conclude that the applicant was separated on 20 May 1947 and his separation document should be corrected accordingly.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was separated from active duty on
20 May 1947 vice 12 February 1926.

The applicant's complete military records are not available to the Board for review. There are no available military records that show he used 23 September 1926 as his DOB during his active duty service. A copy of this decisional document will be filed in his records to clarify any discrepancy between the DOB recorded in his official military personnel file and that shown on his birth certificate.
