         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to reflect award of the Purple Heart. He states he was wounded and received the award in December 1968.

3. Records available to the Board indicate the applicant entered active duty on
27 September 1967. Following completion of training he was assigned to Fort Carson, Colorado as a vehicle driver with the 1st Battalion, 11th Infantry. In July 1968 he was transferred to Vietnam as part of a unit movement.

4. On 2 December 1968 the applicant was wounded as a result of hostile action and awarded the Purple Heart. Orders published by the 312th Evacuation Hospital confirmed the award. He was initially hospitalized in Vietnam and then evacuated to Japan. He was ultimately returned to duty. He departed Vietnam in February 1969 and completed his enlistment at Fort Riley, Kansas. On
30 September 1970 he was released from active duty. His award of the Purple Heart was omitted from his separation document.

5. By virtue of his assignment in Vietnam the applicant is entitled to the Republic of Vietnam Gallantry Cross Unit Citation with Palm and two bronze service stars on the Vietnam Service Medal reflected on his separation document. The bronze service stars denote participation in two designated campaign periods (Vietnam Counteroffensive-Phases IV and V) while in Vietnam.

CONCLUSIONS:

1. The evidence confirms the applicant was awarded the Purple Heart and his records should be corrected accordingly.

2. The Board also notes that the Republic of Vietnam Gallantry Cross Unit Citation with Palm and two bronze service stars on his Vietnam Service Medal were omitted from his separation document.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected:

a. by showing that the individual concerned was awarded the Purple Heart; and




b. by showing that he is entitled to the Republic of Vietnam Gallantry Cross Unit Citation with Palm and two bronze service stars on his Vietnam Service Medal.
