         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to reflect award of the Purple Heart and Combat Infantryman Badge. He states he received the Purple Heart Medal in June 1968 and also "received" the Combat Infantryman Badge. He notes that his separation document makes no mention of either award.

3. Records available to the Board indicate the applicant entered active duty on 16 August 1967. While undergoing training he qualified as a sharpshooter with the rifle (M-14), an expert with the machinegun (M-60), and as marksman with the automatic rifle (M-16). He was awarded the associated badges and component bars, although that information was omitted from his separation document.

4. In May 1968 the applicant was assigned to Vietnam as an infantryman (specialty 11B) with the 2nd Battalion, 28th Infantry. He was wounded on 8 June 1968 and awarded the Purple Heart. Orders issued by the 93rd Evacuation Hospital confirmed the award. As a result of the applicant's wounds, he was medically evacuated from Vietnam and hospitalized at Fort Knox, Kentucky.

5. In January 1969 he returned to military duty at Fort Lewis, Washington, where he remained until he was discharged on 10 December 1970. His separation document does not reflect entitlement to the Purple Heart or the Combat Infantryman Badge.

6. There are basically three requirements for award of the Combat Infantryman Badge. The soldier must be an infantryman (11 series specialty), assigned to an infantry unit during such time as the unit is engaged in active ground combat, and must have actively participated in such ground combat.

7. A review of Department of the Army Pamphlet 672-3 indicates that the applicant's unit (2nd Battalion 28th Infantry) was awarded the Republic of Vietnam Gallantry Cross Unit Citation with Palm, the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, and participated in one designated campaign (Vietnam Counteroffensive Phase IV) while the applicant was a member of the organization. The foreign unit awards were omitted from his separation document and a bronze service star, denoting participation in the designated campaign period, was omitted from his Vietnam Service Medal.

CONCLUSIONS:

1. The evidence confirms the applicant was awarded the Purple Heart for wounds sustained on 8 June 1968. His records should be corrected accordingly.

2. The Board is also satisfied that the applicant met the requirements for award of the Combat Infantryman Badge. The evidence shows that the applicant was an infantryman, assigned to an infantry unit, and the fact that he was wounded as a result of hostile actions, is sufficient evidence of his combat participation. The Board concludes that as such, in the interest of justice and equity, he should be award that badge.

3. The Board also notes that the applicant qualified as a sharpshooter with the rifle (M-14), an expert with the machinegun (M-60), and as marksman with the automatic rifle (M-16). He was awarded the associated badges and component bars and his records should be corrected accordingly.

4. The applicant is also entitled to the Republic of Vietnam Gallantry Cross Unit Citation with Palm, the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, and one bronze service star on his Vietnam Service Medal.

5. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected:

a. by showing that the individual concerned was awarded the Purple Heart;

b. by showing that he qualified as a sharpshooter with the rifle (M-14), an expert with the machinegun (M-60), and as marksman with the automatic rifle
(M-16) and was awarded the associated badges and component bars;

c. by showing that he is entitled to the Republic of Vietnam Gallantry Cross Unit Citation with Palm, the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, and one bronze service star on his Vietnam Service Medal; and

d. by awarding him the Combat Infantryman Badge.
