         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his Report of Transfer or Discharge, DD Form 214, be amended to add the Purple Heart and all other medals to which he is entitled.

3. The applicant states, in effect, that he earned the Purple Heart, the Combat Infantryman Badge (CIB), and all his other awards. He provides his Purple Heart certificate and a certificate showing he was assigned to the 25th Infantry Division as supporting evidence.

4. The applicant’s military records show that he was inducted into the Army on 1 August 1967. He completed basic combat training and advanced individual
training and was awarded military occupational specialty 11B (Light Weapons Infantryman).

5. The applicant arrived in Vietnam on or about 14 April 1968 and was assigned to Company C, 4th Battalion, 9th Infantry, 25th Infantry Division as a rifleman. General Orders 3855, Headquarters, 25th Infantry Division dated 25 May 1968 awarded him the Purple Heart for wounds received in action on 23 May 1968.

6. The applicant departed Vietnam on 8 June 1969 after receiving participation credit for four campaigns and was released from active duty on 10 June 1969 after completing 1 year and 8 months of creditable active service with 70 days of lost time.

7. The applicant’s DD Form 214 shows he was awarded the National Defense Service Medal, the Vietnam Service Medal, the Vietnam Campaign Medal, and the Vietnam Gallantry Cross with Palm Unit Citation.

8. Army Regulation 600-8-22 provides for the award of the CIB to a soldier who is an infantryman satisfactorily performing infantry duties, who is assigned to an infantry unit during such time as the unit is engaged in active ground combat, and must actively participate in such ground combat. It provides for award of one bronze service star to be worn with the appropriate service medal for each credited campaign.

9. Department of the Army Pamphlet 672-3 shows that the 4th Battalion, 9th Infantry was awarded the Republic of Vietnam Gallantry Cross with Palm Unit Citation for the period April 1966 through August 1968 and the Republic of Vietnam Civil Actions Honor Medal, First Class Unit Citation for the period 30 April 1966 through 21 January 1970.

CONCLUSIONS:

1. The evidence of record shows the applicant was awarded the Purple Heart.

2. The evidence of record shows the applicant met the eligibility criteria for award of the Combat Infantryman Badge.

3. The evidence of record shows the applicant was assigned to a unit during a period of time that unit was awarded the Republic of Vietnam Gallantry Cross with Palm Unit Citation and the Republic of Vietnam Civil Actions Honor Medal, First Class Unit Citation. The Republic of Vietnam Gallantry Cross with Palm Unit Citation is already shown on his DD Form 214 but the Republic of Vietnam Civil Actions Honor Medal, First Class Unit Citation should be added.

4. The applicant received campaign participation credit for four campaigns and is therefore authorized to wear four bronze service stars on the Vietnam Service Medal.

5. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That the applicant’s DD Form 214 be amended to show he was awarded the Purple Heart, the Combat Infantryman Badge, and the Republic of Vietnam Civil Actions Honor Medal, First Class Unit Citation and to show he is authorized four bronze service stars with the Vietnam Service Medal.
