         I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. A quorum was present during the further consideration and deliberation. The findings appearing in proceedings dated 6 December 2001 were affirmed. The following additional findings, conclusions, and recommendation were adopted by the Board.

         The Board convened at the call of the Director on the above date to reconsider the conclusions and recommendation appearing in proceedings dated 6 December 2001 .

         The applicant and counsel, if any, did not appear before the Board.

         The Board considered the following additional evidence:

THE BOARD ADDITIONALLY FINDS:

17. On 6 December 2001, the Board recommended that the applicant’s record be corrected to award of the Army Good Conduct Medal, the Vietnam Service Medal with 2 bronze service stars, the Republic of Vietnam Gallantry Cross with Palm Unit Citation, the Presidential Unit Citation, and the Meritorious Unit Commendation.

18. On 8 February 2002, subsequent to the approval of the Board’s recommendation, the Total Army Personnel Command (PERSCOM), Military Awards Branch, identified an omission in the Board’s original recommendation and informed the Board staff.

19. A PERSCOM Military Awards Branch official indicated that the Presidential Unit Citation awarded to the applicant’s unit, 4th Battalion, 503 Infantry Regiment, the Presidential Unit Citation (NAVY), in Department of the Army General Order (DAGO) Number 32, published in 1973, was in fact awarded by the United States Navy and that this fact should be clarified in the Board’s recommendation.

THE BOARD ADDITIONALLY CONCLUDES:

8. At the time of the Board’s 6 December 2001 decision in this case, it was the intent of the Board to make the applicant’s record as administratively correct as it should properly have been at the time of his separation from the Army.

9. Notwithstanding the normal legal finality applicable to the decisions rendered by this Board, in view of the additional factors in this case, the Board finds the original relief granted in this case should be amended.

10. The Board concludes that the relief granted in its original findings should be modified by changing the portion of the recommendation that awarded the applicant the Presidential Unit Citation, to a recommendation that shows the United States Navy awarded this Presidential Unit Citation.

11. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below.


THE BOARD RECOMMENDS:

That all of the Department of the Army records related to this case be corrected by amending the Board’s recommendation appearing in the proceedings, dated 6 December 2001, to show that the individual was awarded the Presidential Unit Citation (NAVY).
