         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that Item 17c, Date of Entry, on his DD Form 214, (Armed Forces of the United States Report of Transfer or Discharge) dated 14 May 1969 be corrected.

3. The applicant states, in effect, that the subject DD Form 214 shows that he was separated on 14 May 1969, but entered service on 8 August 1969. It shows that he served 1 year, 9 months, and 7 days and had prior service of 1 year, 1 month, and 9 days. He states that the date of entry on his 14 May 1969 DD Form 214 should read 8 August 1967. He submits in support of his request a copy of the subject DD Form 214 and his DD Form 214 for the period 29 June 1966 to 7 August 1967.

4. The applicant’s military records show that prior to the period of service under review, he served honorably in the Regular Army from 29 June 1966-7 August 1967. During this period, he attended Officer Candidate School (OCS) at Fort Sill, Oklahoma. Upon successfully completing OCS, he was separated on 7 August 1967 in order to accept a commission as a second lieutenant in the US Army Reserve on 8 August 1967.

5. On 8 August 1968, the applicant was promoted to first lieutenant; this was the highest rank that he achieved. He served in the Republic of Vietnam from May 1968 until he returned to Oakland Army Base, California, in May 1969 for out-processing.

6. On 14 May 1969, the applicant was honorably released from active duty and assigned to the USAR Control Group, St. Louis, Missouri. Item 9b on his DD Form 214, Date of Rank, is correctly shown as 8 August 1968, however, a pen and ink change shows 8 August 1967. Item 17c on the applicant's DD Form 214 incorrectly shows his "Date of Entry" as 8 August 1969. His correct " Date of Entry" is 8 August 1967.

CONCLUSIONS:

1. The applicant is entitled to have his DD Form 214, Item 17c corrected to show that he entered active duty on 8 August 1967. He completed OCS on 7 August 1967 and was separated to accept a commission as a second lieutenant on 8 August 1967.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by issuing to the individual concerned a DD Form 215 (Correction to DD Form 214) to show in Item 17c of his DD Form 214 of 14 May 1969 that he entered active duty on 8 August 1967.
