         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his dates of service and net active service be corrected and that his award of the Meritorious Service Medal (MSM) be added.

3. The applicant states that his DD Form 214 (Certificate of Release or Discharge from Active Duty) does not have the correct date of entry on active duty or his length of active service. He did not receive his MSM until after separation.

4. The applicant’s military records show that he entered active duty on 21 July 1992. On 13 May 1998, he extended his enlistment to 8 December 2000. On 15 June 2000, the applicant was reassigned for the purpose of separation processing. The date of discharge shown on the reassignment orders was 8 December 2000.

5. Effective 8 December 2000, the applicant was discharged from active duty in the pay grade of E-6. His DD Form 214 shows in block 12a. (Date entered AD This Period) 8 December 2000. Block 12c. (Net Active Service This Period) shows the entry 1 day. The MSM is not listed as an authorized award.

6. On 5 September 2000, the applicant was awarded the MSM on Permanent Order 249-1.

CONCLUSIONS:

1. The applicant entered active duty on 21 July 1992 and served on active duty for 8 years, 4 months, and 18 days. He is entitled to correction of his records to reflect this service.

2. The applicant was awarded the MSM on 5 September 2000 and his records should reflect this award.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case for the individual concerned be corrected:

         a. by showing in block 12a of his DD Form 214 the date of 21 July 1992 and the entry 8 years, 4 months, and 18 days in block 12c; and




         b. by showing that he was awarded the MSM.
