THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 1 October 2010 to show he served 4 years and 8 months of active duty and he held military occupational specialty (MOS) 251AO for 5 years.

2.  The applicant states his Active Guard Reserve (AGR) orders were for the period 21 February 2006 to 27 April 2009 and then he was issued permanent change of station orders with a report date of 27 April 2009.

3.  The applicant provides officer evaluation reports and orders.

CONSIDERATION OF EVIDENCE:

1.  The applicant was appointed as a warrant officer in MOS 951AO on 20 February 2006 with prior enlisted service.

2.  He was ordered to active duty in the AGR Program with a reporting date of 21 February 2006 and a projected release from active duty (REFRAD) date of 20 February 2009.  Those orders were amended on 6 January 2009 to make his period of active duty indefinite.

3.  Orders R-02-980292, dated 3 February 2009, reassigned him to another unit with a reporting date of 9 March 2009.  Those orders were amended to show his reporting date as 27 April 2009.

4.  Orders C-07-090485 show he was REFRAD on 1 October 2010.  The DD Form 214 he was issued shows he entered active duty on 27 April 2009 and was REFRAD on 1 October 2010.  Block 11 (Primary Specialty) shows "251AO INFO SYSTEMS TECH – 1 YR 5 MOS//NOTHING FOLLOWS."

DISCUSSION AND CONCLUSIONS:

1.  The applicant's original AGR orders were amended to provide him an indefinite period of active duty.  While the applicant was reassigned to another unit on 27 April 2009, this did not cause a break in his active duty.  

2.  As such, the applicant's DD Form 214 should be corrected to show he entered active duty on 21 February 2006 and was REFRAD on 1 October 2010.  Therefore, the DD Form 214 he was issued for the period ending 1 October 2010 should be corrected as follows:

* Block 12a (DATE ENTERED AD THIS PERIOD) 21 February 2006
* Block 12c (NET ACTIVE SERVICE THIS PERIOD) 4 years, 7 months, 11 days (as calculated below)

3.  In addition, the applicant was awarded MOS 251AO when he was appointed on 20 February 2006.  Therefore, the entry 1 year and 5 months is obviously in error.  The correct entry would be calculated as follows:

	0004  07  11

4.  Therefore, the correct entry in Block 11 for the period ending 1 October 2010 is "4 YRS 7 MOS."

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending:

	a.  Block 12a (DATE ENTERED AD THIS PERIOD) to 21 February 2006;

   b.  Block 12c (NET ACTIVE SERVICE THIS PERIOD) to 4 years, 7 months, 11 days; and

   c.  Block 11 (Primary Specialty) to show "251AO INFO SYSTEMS TECH – 4 YRS 7 MOS//NOTHING FOLLOWS."

2.  The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to showing additional active duty time or time served in his MOS.
