APPLICANT REQUESTS: In effect, that his records be corrected to show his name as S----- M---- instead of J---- L---- J------, Jr.
APPLICANT STATES: In effect, that at the age of thirteen he left his home in Indiana and relocated to Smithville, North Carolina. After his relocation to Smithville he lived under the name of J---- L---- J------, Jr. The applicant submits a copy of a birth certificate and a copy of an Honorable Discharge certificate in support of his application.
EVIDENCE OF RECORD: The applicant's military records show:
On 26 June 1964, the applicant was inducted into the Army of the United States for 2 years. He was inducted under the name of J----L----J------, Jr. On 27 January 1967, the applicant reenlisted in the Regular Army under the same name of J---- L---- J------, Jr.
On 9 October 1970, the applicant was discharged from military service under the name of J---- L---- J------, Jr., in pay grade E-1, under the provisions of Army Regulation 635-212. He had completed a total of 4 years, 9 months and 16 days of creditable active service and had 546 days of lost time.
Army Regulation 635-5 prescribes the separation documents prepared for soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. In pertinent part it states that the DD Form 214 is a synopsis of the soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
2. The applicant’s official military record shows that he was inducted and that he served his entire military career under the name of J---- L---- J------, Jr. His record also shows that he was discharged from the military under the same name. The documents submitted by the applicant are insufficient and therefore, does not warrant a correction of official military records.
3. For historical purposes, the Army has an interest in maintaining the accuracy of its records. The data and information contained in those records should actually reflect the conditions and circumstances that existed at the time the records were created. In the absence of a showing of material error or injustice, this Board is reluctant to recommend that those records be changed.
4. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
