         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his military records be corrected to reflect award of the Purple Heart.

3. The applicant states he was awarded the Purple Heart, however, it was never reflected on his report of separation (DD Form 214).

4. The applicant’s military records show that he was inducted on 23 October 1968 and entered active duty on that same date. Upon completion of basic combat training and advanced individual training, he was assigned to Vietnam and arrived there on 19 October 1969. On 7 March 1970, he was wounded in action and was awarded the Purple Heart by General Orders Number 3621, dated 7 April 1970. On 27 September 1970, he was recognized for exemplary behavior, efficiency, and fidelity by award of the Good Conduct Medal, by General Orders Number 9906, dated 27 September 1970.

5. The applicant returned from Vietnam and was separated on 12 October 1970, in the pay grade of E-5 with 1 year, 11 months, and 20 days active Federal service. His DD Form 214 reflects entitlement to the Combat Infantryman Badge, the Air Medal with 2 awards, the Bronze Star Medal with 2 oak leaf clusters, the Vietnam Campaign Medal, the Vietnam Service Medal, and the National Defense Service Medal. The Purple Heart and the Army Good Conduct Medal were not entered on his DD Form 214.

6. A review of Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) notes the applicant’s unit (22nd Infantry, 25th Infantry Battalion) was credited with participating in four designated campaigns during the applicant’s period of assignment, which entitles him to four bronze service stars. Also, based on the unit’s period of participation, the applicant should be awarded the Republic of Vietnam Gallantry Cross with Palm Unit Citation and the Republic of Vietnam Civil Actions Honor Medal, First Class Unit Citation.

7. Army Regulation 600-8-22 provides that bronze service stars are awarded to represent participation in designated campaign periods. During the Vietnam era the bronze service stars were affixed to the Vietnam Service Medal.

CONCLUSIONS:

1. Although the evidence of record confirms that orders were published awarding the applicant the Purple Heart and the Army Good Conduct Medal they were never entered on his DD Form 214. Accordingly, it would be in the interest of justice to do so at this time.

2. The applicant is eligible for four bronze service stars for his already awarded Vietnam Service Medal, by virtue of his participation in four campaigns during his service in Vietnam.

3. The Unit Citation and Campaign Participation Credit Register confirms that the applicant should be awarded the Republic of Vietnam Gallantry Cross with Palm Unit Citation and the Republic of Vietnam Civil Actions Honor Medal, First Class Unit Citation. Accordingly, it should also be done at this time.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION: That all of the Department of the Army records related to this case be corrected:

a. by showing that he was awarded the Purple Heart and the Army Good Conduct Medal; and,

b. by awarding him the Republic of Vietnam Gallantry Cross with Palm Unit Citation, the Republic of Vietnam Civil Actions Honor Medal, First Class Unit Citation, and four bronze service stars.
