                            RECORD OF PROCEEDINGS

      IN THE CASE OF:

      BOARD DATE: 1 NOVEMBER 2005
      DOCKET NUMBER: AR20050002541

I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.

| |Mr. Carl W. S. Chun | |Director |
| |Ms. Deborah L. Brantley | |Senior Analyst |

The following members, a quorum, were present:

| |Mr. James Anderholm | |Chairperson |
| |Mr. Thomas O’Shaughnessy | |Member |
| |Ms. Carol Kornhoff | |Member |

The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that his records be corrected to reflect two
awards of the Purple Heart.

2. The applicant states there was no room on his separation document to
record the two Purple Hearts. He would like them added to his separation
document if correct.

3. The applicant provides no evidence in support of his request.

CONSIDERATION OF EVIDENCE:

1. Records available to the Board indicate the applicant entered active
duty on 27 March 1969. He was trained as an infantryman and following
completion of training, in September 1969 he was assigned to the 1st
Battalion, 5th Cavalry in Vietnam.

2. The applicant was wounded in action on 6 February 1970. Orders issued
by the 1st Cavalry Division confirmed his award of the Purple Heart. It is
not, however, recorded on his separation document.

3. An entry in item 40 (wounds) on his Department of the Army Form 20
(Enlisted Qualification Record), an entry in his service medical records,
and his name on a list of individuals reported as combat casualties in
Vietnam confirm that he was wounded a second time as a result of hostile
action on 20 March 1970. There is, however, no indication that he was ever
awarded the Purple Heart for the second wound.

4. The applicant departed Vietnam in September 1970 and completed his
enlistment contract at Fort Benning, Georgia. He was released from active
duty on 17 January 1972 under an early release program in effect at that
time.

5. A review of Department of the Army Pamphlet 672-3 (Unit Citation and
Campaign Participation Credit Register) notes the applicant’s unit was
credited with participating in four designated campaigns (Vietnam
Counteroffensive Phase VII, Sanctuary Counteroffensive, Vietnam Summer-Fall
1969, and Vietnam Winter-Spring 1970) during the applicant’s period of
assignment. Four bronze service stars on the Vietnam Service Medal, vice
the one bronze service star currently recorded on his separation document,
should reflect his campaign participation. The unit was also awarded two
awards of the Republic of Vietnam Gallantry Cross Unit Citation with Palm;
the Republic of Vietnam Civil Actions Honor Medal First Class Unit
Citation; and a Valorous Unit Award during his tenure with the
organization. The unit awards were also omitted from his separation
document.

DISCUSSION AND CONCLUSIONS:

1. The evidence confirms the applicant was wounded on two separate
occasions while in Vietnam; once on 6 February 1970 and again on 20 March
1970. He is entitled to two awards of the Purple Heart and his records
should be corrected accordingly.

2. The evidence also shows the applicant is entitled to four bronze
service stars on the Vietnam Service Medal, vice the one bronze service
star currently recorded on his separation document; two awards of the
Republic of Vietnam Gallantry Cross Unit Citation with Palm; one Republic
of Vietnam Civil Actions Honor Medal First Class Unit Citation; and a
Valorous Unit Award.

BOARD VOTE:

__JA____ __TO ___ __CK ___ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected:

      a. by showing he was awarded a Purple Heart for wounds sustained on
6 February 1970;

      b. by awarding him a second Purple Heart for wounds sustained on
20 March 1970; and

      c. by showing that he is entitled to four bronze service stars on the
Vietnam Service Medal, vice the one bronze service star currently recorded
on his separation document; two awards of the Republic of Vietnam Gallantry
Cross Unit Citation with Palm; one Republic of Vietnam Civil Actions Honor
Medal First Class Unit Citation; and a Valorous Unit Award.

According to the award certificate provided by the applicant, he was awarded the Republic of Vietnam Gallantry Cross with Palm, as an individual award on 1 August 1969. Army Regulation 672-5-1 (Military Awards) provided for award of the Army Good Conduct Medal to individuals who completed a qualifying period of active duty enlisted service. While he doesn’t provide evidence confirming his correct SSAN, the majority of documents in his file show the middle two digits of his SSAN as “84” vice “81.” It’s possible his DD Form 214 shows the digits “81” because those were the numbers on the orders releasing him from active duty. As a result, the Board...

There is no evidence in the available records which shows that the applicant was awarded the Purple Heart or was wounded as a result of hostile action in Vietnam. Medical evidence of record shows the applicant was accidentally injured in a mortar attack in Vietnam on 30 June 1970. Therefore, his records should be corrected to show only one award of this unit citation.
