PROCEEDINGS

         IN THE CASE OF:

         BOARD DATE: 14 March 2002
         DOCKET NUMBER: AR2001063947

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
Ms. Stephanie Thompkins Analyst

The following members, a quorum, were present:

Ms. Joann H. Langston Chairperson
Mr. Walter T. Morrison Member
Mr. Roger W. Able Member

The applicant and counsel if any, did not appear before the Board.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2. The applicant requests, in effect, correction to his military records to show his correct social security number.

3. The applicant states that at the time of his retirement his social security number was incorrectly annotated on his retirement orders. He submits copies of his social security card, retirement identification card, medicare insurance card, his wife’s military identification card, and retirement orders in support of his request.

4. The applicant’s military records were lost or destroyed in the National Personnel Records Center fire of 1973. Information herein was obtained from alternate sources and documentation submitted by the applicant.

5. The applicant was retired from the United States Army by reason of physical disability on 10 July 1969.

6. Available records show when he enlisted in the military he was assigned a service number.

7. His retirement orders, dated 24 June 1969, incorrectly show the sixth digit of his social security number as a “2”.

8. Evidence submitted by the applicant show the sixth digit of his social security number as a “3”.

CONCLUSIONS:

1. The applicant is entitled to correction to his social security number on his retirement orders. The sixth digit was erroneously entered as a “2”.

2. The Board notes that the applicant’s available records show he was identified through his military service with a service number. At the time of his retirement in 1969, his service number and social security number were entered on his retirement orders. Documentation submitted with the application shows the sixth digit of the social security number should be “3”.

3. Therefore, it is concluded that the sixth digit of the social security number was erroneously entered as a “2” on the applicant’s retirement order and should be corrected to show “3”.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing on the retirement orders of the individual concerned the sixth digit of the social security number as a “3”.

The applicant states that his discharge is unjust and needs to be changed to honorable or upgraded to a better discharge. However, his DD Form 214 indicates that he was discharged with an undesirable discharge on 26 August 1974 under the provisions of Army Regulation 635-206, Section VI, for misconduct – conviction by a civil court or adjudged a juvenile. The Board noted the applicant's request for correction of item 9a (Type of Separation) on his DD Form 214 to show "honorable."

There is no evidence in the available records which shows the applicant was awarded the Purple Heart or was wounded as a result of hostile action in Vietnam. Evidence of record shows the applicant was awarded an infantry MOS. Based on the foregoing, the Board determined that the evidence of record does not support award of the Purple Heart in this case.
