         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that a DD Form 214 (Certificate of Release or Discharge from Active Duty) be prepared to cover his active duty service from 8 July 1994 to 9 April 1997.

3. The applicant states that a DD Form 214 was not prepared at the time he vacated his Warrant to accept a commission as a second lieutenant.

4. The applicant’s military records show that the applicant enlisted in the Army on 26 April 1994 for 3 years, for training as a Helicopter Pilot.

5. On 7 July 1994, he was honorably discharged for the purpose of accepting appointment as a warrant officer.

6. On 8 July 1994, he was ordered to active duty as a Warrant Officer One.

7. On 9 April 1997, he was honorably discharged for the purpose of accepting a commission. He was not issued a DD Form 214 for his period of service as a warrant officer (8 July 1994 to 9 April 1997).

8. On 10 April 1997, he was ordered to active as a second lieutenant.

9. 15 September 2001, he was separated from active duty and transferred to the Reserve control Group (Reinforcement). His DD Form 214 issued for this period of service did not list his warrant officer service.

CONCLUSIONS:

1. The evidence of record clearly shows the applicant served on active duty from 8 July 1994 to 9 April 1997 as a warrant officer and his records should be corrected accordingly.

2. His DD Form 214 issued on 15 September 2001 should be corrected to include his warrant officer service.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that item 12a (Date entered AD This Period), DD Form 214, dated 15 September 2001, of the individual concerned, is 19940708 and that item 12c (Net Active Service This Period) is 00070208.
