PROCEEDINGS

         IN THE CASE OF:

         BOARD DATE: 30 October 2001
         DOCKET NUMBER: AR2001063145

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
Mrs. Nancy Amos Analyst

The following members, a quorum, were present:

Ms. Celia L. Adolphi Chairperson
Mr. Arthur A. Omartian Member
Mr. Harry B. Oberg Member

The applicant and counsel if any, did not appear before the Board.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2. The applicant requests her enlistment contract be corrected to show she enlisted in pay grade E-2.

3. The applicant states that her enlistment contract erroneously shows she enlisted in pay grade E-4.

4. The applicant’s U. S. Army Recruiting Command reservation sheet shows and the U. S. Army Recruiting Command Liaison at Fort Leonard Wood, MO confirms that she enlisted in the Regular Army on 28 August 2001 in pay grade E-2. Her Enlistment/Reenlistment Contract, DD Form 4/3, item 21a erroneously shows she enlisted in pay grade E-4.

CONCLUSIONS:

1. There is an administrative error on the applicant’s DD Form 4/3. The evidence of record shows she enlisted on 28 August 2001 in pay grade E-2, not in pay grade E-4.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That the applicant’s DD Form 4/3 dated 28 August 2001, item 21a be corrected to show she enlisted in pay grade E-2.

She contends that in June 1999, she requested an extension of her mandatory retirement date (MRD) of 30 November 1999, which was disapproved on 8 February 2000. The applicant’s contention that she requested an extension of her MRD; that it was disapproved; and that she was not so informed, is fully supported by the evidence presented to the Board. Therefore, her military records should be corrected to grant her full credit for actual time served.

The applicant’s military records show that, with prior service, he reenlisted in the United States Army Reserve (USAR) on 2 May 1999 for a period of 6 years. On 8 August 1999, the applicant's unit requested that he be authorized the SRIP and SLRP as an exception to policy and forwarded the request to the 99 th RSC Retention Office. The Board concludes that had it not been for an administrative error, the applicant would have known that his MOS was eligible for the SRIP and SLRP.
