The Board convened at the call of the Director on the above date to reconsider the conclusions and recommendation appearing in proceedings dated 13 September 2001.

Mr. Raymond J. Wagner Chairperson
Mr. Kenneth W. Lapin Member
Ms. Paula Mokulis Member

The applicant and counsel, if any, did not appear before the Board.

The Board considered the following additional evidence:

         Exhibit C – 13 September 2001 Board Proceedings

THE BOARD ADDITIONALLY FINDS:

24. On 19 September 2001, the applicant’s case as considered by the Board on 13 September 2001 was reviewed. This review revealed that item 12 (Last Duty Assignment and Major Command) of his DD Form 214 should have been corrected to show the entry “7th Infantry Division”.

THE BOARD ADDITIONALLY CONCLUDES:

12. At the time of the Board’s 13 September 2001 decision in this case, it was the intent of the Board to make the applicant’s record as administratively correct as it should properly have been at the time of his separation.

13. The recommendation to correct item 12 (Last Duty Assignment and Major Command) of his DD Form 214 was inadvertently omitted.

14. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below.

THE BOARD RECOMMENDS:

That all of the Department of the Army records related to this case be further corrected by amending the Board’s recommendation appearing in the Proceedings, dated 13 September 2001:

         c. to show the entry “7th Infantry Division” in item 12 (Last Duty Assignment and Major Command) of his DD Form 214.

The applicant requests that his military occupational specialty (MOS) be changed from 3844 to 3705. The applicant states that when he entered the service, he was given the MOS 3844, however, when he was shipped to Korea, he was made an artillery forward observer, MOS 3705. The applicant requests that his records be corrected to reflect award of the Combat Infantryman Badge. He states that he served 12 months in Vietnam and was issued the Combat Infantryman Badge but it was never documented on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). There is, however, no indisputable evidence in available records that the applicant ever “satisfactorily performed” his duties as an infantryman while his “unit was engaged in active...

During its original review of the case, the Board found no military records that supported the applicant’s claim that he was wounded in action or that he was ever treated for a wound or injury received as a direct result of or that was caused by enemy action. The Board also concluded that the evidence of record showed the applicant served in aviation units during his tour of duty in the RVN, and that he did not serve in a qualifying infantry unit that would entitle him to receive the CIB. ...
