         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show that he was awarded the Korea Defense Service Medal, the Republic of Korea Presidential Unit Citation, and the Good Conduct Medal.

3. The applicant states that his DD Form 214 does not show that he was awarded the Good Conduct Medal, the Korea Defense Service Medal or the Republic of Korea Presidential Unit Citation. In support of his application, he submitted a supplemental letter, a copy of his DD Form 214, his Honorable Discharge Certificate, general orders awarding the Good Conduct Medal, and a listing of decorations for the 73rd Armor Tank Battalion.

4. The applicant's request for correction of his records to show award of the Korea Defense Service Medal was addressed by separate correspondence. Therefore, award of the Korea Defense Service Medal will not be discussed further in these Proceedings.

5. The applicant's military records have been lost or destroyed. This case is being considered using reconstructed records. The applicant's reconstructed records consist primarily of his DD Form 214. This record shows that he was inducted into the Army on 18 July 1955. He completed training as an armor crewman and completed 1 year, 4 months, and 2 days of foreign service; however, there is no indication of the location or dates of this foreign service. The applicant was honorably released from active duty on 3 July 1957.

6. Item 26 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) on the applicant's DD Form 214 does not show entitlement to any awards during this period of service.

7. There is no evidence available to the Board which shows the specific dates in which the applicant served in Korea.

8. Item 12 (Last Duty Assignment and Major Command) on his DD Form 214 shows he was assigned to Company B, 73rd Tank Battalion.

9. The Department of the Army Pamphlet 672-1 (Unit Citation and Campaign Participation Credit Register) shows that the 73rd Tank Battalion of the 7th Infantry Division was cited for award of the Republic of Korea Presidential Unit Citation for the period 19 September 1950 to 31 July 1952 during the Korean War.

10. The Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) shows the 73rd Tank Battalion of the 7th Infantry Division was cited for award of the Republic of Korea Presidential Unit Citation for the period 17 September 1950 to 27 March 1971 by Department of the Army General Orders Number 50, dated 1971.

11. The applicant's reconstructed records contain a DA Form 1577 (Authorization for Issuance of Awards), dated 15 February 2000, which shows the applicant was issued the first award of the Good Conduct Medal.

12. The applicant provided a copy of U.S. Army Transfer Station, Fort Sheridan, Illinois, Special Orders Number 134, dated 2 July 1957, which awarded him the first award of the Good Conduct Medal for the period 18 July 1955 to 3 July 1957.

CONCLUSIONS:

1. Evidence of record shows that the applicant was a member of the 73rd Tank Battalion of the 7th Infantry Division in Korea during a portion of his active duty service.

2. However, there are no records which show the specific dates of his service in Korea.

3. The applicant's DD Form 214 shows that he served on active duty from 18 July 1955 through 3 July 1957.

4. Department of the Army General Orders show that the units of the 7th Infantry Division were entitled to award of the Republic of Korea Presidential Unit Citation for the period 17 September 1950 to 27 March 1971.

5. Since the applicant's service in the 7th Infantry Division overlaps the period of eligibility for the Republic of Korea Presidential Unit Citation, he is entitled to award of the Republic of Korea Presidential Unit Citation and correction of his records to show this foreign unit award.

6. The applicant was awarded the Good Conduct Medal for the period 18 July 1955 to 3 July 1957. Therefore, his DD Form 214 will be corrected to show award of the Good Conduct Medal.

7. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below.






RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the Republic of Korea Presidential Unit Citation and the Good Conduct Medal.
