THE BOARD ADDITIONALLY FINDS:
12. On 12 August 2001, the applicant amended his application, by letter, to request that his records be corrected to show his effective date of promotion to captain also be corrected. He states that his date of rank (DOR) was corrected but the Defense Finance and Accounting Service will not pay him back pay and allowances because the Board’s directive did not correct the effective date of his promotion.
13. Conversation with the U. S. Total Army Personnel Command, Office of Promotions, Reserve Components indicated that a correction was made to the Recommendation in the original Proceedings to show the applicant was promoted to captain with a date of rank of 8 August 1995 (vice 8 August 1996). That office also indicated that the 1995 Reserve Components Selection Board for captain, Army Medical Department adjourned on 9 February 1995.
THE BOARD ADDITIONALLY CONCLUDES:
3. At the time of the Board’s 22 March 2001 decision in this case (docket number 2000049104), it was the intent of the Board to make the applicant’s record as administratively correct as it should properly have been at the time of the Board’s action.
4. Army Regulation 135-155 specifies that an officer is promoted after selection if all qualifications for promotion are met. The applicant was selected under the 1995 criteria. The 1995 promotion board adjourned on 9 February 1995. Since this was prior to the applicant’s promotion eligibility date of 8 August 1995, he would have been eligible for promotion (DOR and effective date) on 8 August 1995.
5. In view of the additional factors in this case the applicant is entitled to correction of his record to show he was promoted to captain with a DOR and effective date of 8 August 1995.
6. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below.
THE BOARD RECOMMENDS:
That all of the Department of the Army records related to this case be corrected by amending the Board’s recommendation appearing in the proceedings, dated
22 March 2001, to show that the applicant was promoted to captain with a date of rank and effective date of 8 August 1995.
