         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests her enlistment contract be corrected to show her enlistment pay grade as E-3.

3. The applicant states that the Professor of Military Science (PMS) was not available to provide a recommendation for advanced pay grade based on her 4 years of Junior Reserve Officers Training Corps (JROTC).

4. The applicant’s military records show that on 14 April 2000, she enlisted in the Army Reserve Delayed Enlistment Program.

5. On 20 June 2000, she enlisted in the Regular Army for 3 years, in pay grade E-2.

6. On 26 August 2000, the JROTC PMS provided the necessary documentation to advance her pay grade to E-3, effective upon enlistment.

7. Army Regulation 601-210 (Regular Army and Army Reserve Enlistment Program) indicates, in pertinent part, that promotion authorities will advance or promote soldiers when they are eligible for enlistment in an advanced grade, but did not have the required documentation at the time of enlistment. Advancement to the proper grade will be made on presentation of the required documentation. Documents must be presented within 1 year from the date of enlistment and entitlement to the higher grade must have existed at the time of enlistment. DOR and the effective date will be the date of the enlistment agreement. Paragraph 2.20 b, of this regulation, is the authority for enlistment in pay grade E-2 as a high school graduate and E-3 as a high school graduate with one or more years in JROTC.

CONCLUSIONS:

1. The evidence of record clearly shows the applicant presented the required documentation within the required time limit and her records should be corrected accordingly.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned enlisted into the Regular Army on 20 June 2000 in pay grade E-3.
