APPLICANT REQUESTS: That he be awarded the Purple Heart.
APPLICANT STATES: That he was injured by enemy fire while in aerial flight on a combat support mission in October 1969. He was treated at the dispensary at Camp Holliway. He provides no supporting evidence.
EVIDENCE OF RECORD: The applicant's military records show:
He enlisted in the Regular Army on 10 May 1965. He served three tours in Vietnam. His second tour was from on or about 23 January 1969 through 16 January 1970. During this tour he was first assigned to Battery B, 2d Battalion 94th Artillery as a cannoneer and switchboard operator. On 5 May 1969, he was assigned to the 179th Aviation Company as a doorgunner and transport helicopter flight engineer.
The applicant’s Enlisted Qualification Record, DA Form 20, item 40, does not show that he was ever wounded. His service medical records are not available.
The applicant was separated on 18 December 1973.
Army Regulation 600-8-22 provides, in pertinent part, that the Purple Heart is awarded for a wound sustained as a result of hostile action. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by a medical officer, and the medical treatment must have been made a matter of official record.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. The Board is cognizant of the applicant’s long service in Vietnam; however, there is no evidence of record and he provides none to show he was wounded in action.
2. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
