         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to show he completed 15 years, 4 months and 27 days of active service.

3. The applicant states that the Army Reserve Personnel Command sent him a letter on 10 April 2001 which indicated he had only 6 years, 7 months and 18 days of qualifying service for retirement.

4. The applicant’s available military records show that he served in the Army Reserve Delayed Enlistment Program from 17 March to 28 April 1977 (1 month and 12 days).

5. During the period 29 April 1977 to 25 September 1992 (15 years, 4 months and 27 days), he served in the Regular Army.

6. On 25 September 1992, he was honorably separated under Army Regulation 635-200, chapter 16-8, based on the 1992 Enlisted Voluntary Transition Program. He received Special Separation Pay in the amount of $41,664.96. He was transferred to the Army Reserve Control Group (Reinforcement).

7. On 10 April 2001, he was advised by the Transitions and Separations Branch of the Army Reserve Personnel Command that he had completed 6 years, 7 months and 18 days of qualifying service for retirement as shown on an attached chronological record of military service.

8. His Certificate of Release or Discharge from Active Duty (DD Form 214) shows he entered active duty on 29 April 1977 and separated on 25 September 1992, with 15 years, 4 months and 27 days of net active service this period.

CONCLUSIONS:

1. The applicant is entitled to correction of his records to show his total active duty service.

2. The evidence of record, including the applicant’s DD Form 214, clearly shows he completed 15 years, 4 months and 27 days of active duty in the Regular Army and his records should be corrected accordingly.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned completed 15 years, 4 months and 27 days of active service in the Regular Army.
