         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that her 2001 Department of Defense Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to reflect her 2 years, 4 months, and 15 days of prior active duty. She makes no statement regarding her request, but does submit copies of her previous separation report confirming her prior active duty service.

3. Records available to the Board indicate that the applicant entered active duty, as an enlisted soldier, on 31 March 1992 and served on active duty until she was released from active duty on 15 August 1994 for the purpose of entering an officer training program. Her active service between 1992 and 1994 consisted of 2 years, 4 months, and 15 days.

4. The applicant was commissioned as a United States Army Reserve second lieutenant in January 1997 following completion of a Reserve Officer Training Corps program at Santa Clara University in Santa Clara, California.

5. She returned to active duty on 3 February 1997 and was released from active duty on 17 June 2001, upon completion of her required active duty service. Item 12d (total prior active service) on her June 2001 separation document does not reflect her 2 years, 4 months, and 15 days of prior active service as an enlisted soldier.

6. Army Regulation 635-5, which establishes the policies and provisions for the preparation and distribution of separation documents, notes that item 12d will reflect total prior active service from previously issued Department of Defense Forms 214.

CONCLUSIONS:

1. The evidence available to the Board confirms that the applicant had 2 years,
4 months, and 15 days of active duty as an enlisted soldier between 1992 and 1994. That information, however, was omitted from item 12d on her 2001 separation document.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected





by showing in item 12d of the applicant’s 2001 Department of Defense Form 214 that she had 2 years, 4 months, and 15 days of prior active service.
