         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to reflect that he was awarded the Purple Heart. He states, in effect, that the award was omitted from his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). In support of his request he submits a copy of his Purple Heart Certificate.


3. Records available to the Board indicate the applicant served on active duty between 1963 and 1969. On 21 December 1968, while performing duties as an infantryman in Vietnam, the applicant stepped on an enemy land mine, sustaining severe trauma to his right foot. As a result of his injuries he was medically evacuated from Vietnam and ultimately retired by reason of disability.

4. He was awarded the Purple Heart by the Commander, 3
rd Field Hospital on
22 December 1968. The award, however, was omitted from his 1969 DD Form 214.

CONCLUSIONS:

1. The evidence confirms the applicant was wounded as a result of hostile action while in Vietnam and awarded the Purple Heart. His records should be corrected accordingly.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Purple Heart.
